I'm not sure that entire statute isn't facially unconstitutional. It's absurdly broad.

That came up when the law was introduced in Minnesota in 2016. It was a badly written, overly broad law of questionable constitutionality that was designed from the start to be open to abuses. The law was sold to the state one way and written in quite another way.

In 2019, the state court of appeals rightfully threw it out as written as clearly unconstitutional.

But then the state supreme court got ahold of it and made what is arguably among the worst decisions in the legal history of the state. The Supreme Court agreed that the law was overly broad and could well apply for example to pictures of a woman breastfeeding a child. That the law was not restricted to material associated with obscenity or "prurient interests". That the law was open to gross abuses.

After the Supreme Court admitted and conceded nearly all of the problems with the law as written, it said that it was constitutional anyway. The argument they used was that right of the government to keep people "healthy and safe" are higher rights than any enumerated right such as the first amendment. That first amendment rights are constitutionally balanced against other important considerations. That speech under the first amendment can be restricted as long as the court considers the restrictions to be in a "narrow fashion".

They asserted as well that a law passing a "strict scrutiny" test makes any question of the law being overly broad irrelevant. That any law that passes strict scrutiny is obviously constitutional no matter how broad its provisions are.

As bad as the decision was in upholding the revenge porn law, its worse in that it provides a constitutional framework for attacking or undermining nearly every other protection in the bill of rights at the state level.

There is less than zero chance of getting the state courts to take any action against that law.
