The judge went out of his way not to make a ruling on it and the prosecutor claimed April’s comments were hearsay and that was why they weren’t using it. I feel like the kiwi reporters shouldn’t have missed such a major part of the hearing, which lead to pages and pages of speculation as a result.
I’m grateful for their service and I agree that people always should be in person, but at the same time I think they dropped the ball there.

If a violation of her rights had indeed taken place then you could bet her lawyer would have brought that up in her motion to dismiss. But contrary to Nick, April has an actual lawyer who is not just an sockpuppet for Nick to file his schizoid rants and delusional legal arguments. Might indeed still bring that up at a later point, but then we would 100% get to see her bodycam footage as evidence in her own case.
 
Hello everyone. I've been lurking for a long time- I'm a therapist and I know Nick's type very well. He's an average-intelligence narcissist who Dunning-Krugers his way through life. He thinks he's an expert rhetorician while playing middle-school-level word games. Definitely was not told "no" enough, which led to him believing he' s always right and therefore people should respect him. He respects no one, not even Dax (aka Juju the Sodomy Cow.) That's just jealousy- he wants Dax's life, even getting dressed up as a cow and getting pegged. He's entitled to people's time and attention (and superchat $$) because he's the Smart and Cool Guy. The ladies in his life are for show, as are his children. "See how cool I am? I've got bitches on my dick but I'm also a caring parent and a successful lawyer! I do cool shit like drugs and weird sex stuff, of course everyone else thinks I'm awesome!"

One thing I found interesting was his claim of having ODD. In my experience. ODD is a symptom of a greater problem, not necessarily a standalone disorder. There is usually some psychological trauma or other mental health issue below the surface causing the oppositional behavior and once that's addressed the ODD becomes less of a problem. BUT. He does not have ODD. Obviously because it's a disorder of childhood, but also because if anything he's a Conduct Disorder kid. Conduct disorder is the precursor to antisocial personality disorder in adults- it involves things like risky behaviors (drugs, sex,) cruelty to animals, and general disregard for others. He'd like people to believe he's a cool Oppositional and Defiant guy, a loner, a rebel, no one can tell him what to do, etc. but he's really a narcissist with antisocial features.

Not to give away my secrets, but the best way to deal with this type of person is to get them to believe things are their idea. It's easier with kids but it can be done with adults who are very into being The Smartest Guy in the Room- tell them about 80% of a course of treatment with one glaringly obvious bit missing. Being so so so smart, they usually jump at the chance to fill in the missing 20%, and then you can be like "wow! I never thought of it that way!" and they've invented therapy! It was all their idea. I'm an idiot for not thinking of it and they totally got one over on me. This might be a little unorthodox but personality disorders are very tough to treat. I've used this technique in my personal life too (slight PL but child of narcissists.)

I believe the issue is not one of explicit permission.

Unless she actually told him not to share the photos (presumably she didn't) the issue is whether he reasonably should have known she did not consent.

If she's a huge slut that fucks random strangers and has already posted nude photos online, why would he reasonably expect that this time is different?

The official understanding that everyone was working with was “the prosecution wasn’t allowed to use April’s testimony in the body cam” and most discussion related to it was about why this could be the case and how the prosecution could potentially still use it. Absolutely nobody offered the idea that there was never a ruling or that this was in accurate because it was just assumed to be correct. Made further by Nick’s stream afterward.

This all happened before April’s motion to dismiss.

I think it’s more of a fact that Kayla was the first woman who would actually get with Nick, whereas April is the first “trophy” he got after he felt like he was a mega celebrity and could get anyone.

I wish that were true, but the fact is people were running with Nick’s account without questioning it. When I asked for those who’d been present to clarify whether things had actually played out the way Nick claimed, instead I got people who weren’t there replying with guessing games as to what they thought might have happened. This is all visible if you go back in the thread to the day it happened. It was extremely regrettable.

I don’t blame those present for not nailing down all the procedural details. There was a lot to take in and the hearing ended pretty quickly.

I hate the majority of millennials. Most of us are stunted teenagers who never had to man up like our grandfathers. Not all but a large majority. Being married and having kids means nothing if you've had to act like a man before.

And that is perfectly accurate. Anything April said about the case against Nick and Kayla during the execution of the warrant cannot be used unless she is called as a witness because the defendant has a right to confront and challenge what April says or has said in the past.
The thing is that IF April is called as a witness, she can plead the 5th, but then the bodycam footage can be played and she can be asked about the things she said there.

The admissibility of that footage and what April said is in question and will be argued about in detail and I would expect her lawyer to be present should she testify to advise her.
All the above is 6th amendment material and was discussed as such by multiple lawyers and widely expected.

The other point here is that Nick accuses the police of violating her 5th amendment right, but if such a violation really happened would have to be shown via bodycam footage. If they did, as the report says, read April her rights and stopped directly asking her questions after she requested to speak to a lawyer, but then volunteered information, then there is nothing Nick can do about that.

And he cannot challenge this part anyway, because its not his rights. If the information given by April is not self-incriminatory then she might not even be able to plead the 5th anyway. This would be for motion in limine to argue.

[EDIT] I understand that a few people might have gotten this wrong, but I think the majority here understood the explanations given.

2) Keep her quiet for as long as possible,

Then April can go online and say that XYZ happened and Nick will just laugh it off and do very smug toast to the camera, because she'd have lost all her leverage over him by then. She will just be a "jilted ex-friend" whose words "can't be trusted", and the criminal cases will be resolved so her testimony doesn't matter.

He still denies going to Hedonism II, so use that as a data point to triangulate the likelihood of Nick admitting anything.

One of the clergy that's involved with Nick's kids' education was one of the people who reported Nick to CPS

Kayla is an anxious shut-in stay at home mom with no ambition or drive. Whether that’s a result of living with Nick for 20 years or she was always like that, who knows.
April has “no fucks given” coolness, is impetuous and a risk taker, and zero responsibilities. She wants to do things like go to dumb tattoo conventions and gallery openings and be shown off, which aligns with what Nick wants, and Kayla is easily influenced so she then wants to do the fun things too.

Plus she’s younger. Nick can live out his “Golly gee, I’m a cool young stud in his 20ies with zero responsibilities!” Fantasies through her.

Kayla is baggage. Miscarriages and five kids. Nick “wasting” the best years on boring prude shit like being a father and responsible income earner.

Yes, a lot of reasonableness. But a person sharing a nude pic with a lover or polycule/private group in itself does not operate as consent to that person or those people further disseminating the picture. The presumption is that things shared privately are intended to be private. It's a high hill to claim, absent a clear statement otherwise, to suggest he shouldn't reasonably have known she didn't consent to him sending it around, and also that it wasn't reasonable for him to believe she had a reasonable expectation of privacy about private pictures made or shared privately.

Statute:
As the statute you cite states, no such "presumption" exists for either of those two elements. Instead, it is a necessary element which must be proven that Aaron knew or should have known that there was an expectation of privacy. Same for the other element.

The parameters of the swinging relationship between the Rekietas and Imholtes will need to be defined in some detail in order to prove those two elements.

It also means that Aaron could potentially claim that Nick and Kayla's long-standing public reputation as exhibitionist nudist swingers is relevant. Remember, Aaron has already said he knew about their "reputation" before the wife swapping ever happened.

A polycule or swinging group, as ick as it is, is still an intimate relationship. It's never been suggested, even by Aaron, that the ethos of the thing was a total free-for-all, spread my personal bits around to anyone and everyone.
