My money is on typo.

There are reports throughout the thread that Kayla would throw things at Nick. It's possible she hit the kids when doing so (even if accidentally.) It's also speculated that one of the kids got into some drugs and caused a medical event. Neither of those explain why Nick wasn't charged under a similar failure to act statuate.

Because of the discrepancy my personal guess is that it's a misclick in the generation of the charging document. The prosecutor's office almost certainly has software that auto-generates the pretty document. A simple misclick on a dropdown or checkbox could be very easily overlooked in preliminary paperwork.

Fingers crossed that's what it works out to, anyways. :-/
