Based on the screenshot provided, they are charged under different subsection. His is allowing a child around drugs (which is neglect). Hers is allowing actual, continual physical or sexual abuse.

Neglect and abuse are different in MN*. And that's my puzzle here bc there is no charge for abuse, so her permitting it doesn't tie to anything. Maybe for purposes of these things, MN considers the b2 offense "abuse" for purposes of allowing a spouse to get an a2 charge, but that seems...like very poor drafting that could easily be made explicit. Or there is some "abuse" that is not by Nick or Kayla that Kayla knew about and let continue, though that's getting into weird territory far beyond anything seen or suggested**.
