I thought the $5k monthly business expense was his mortgage, electricity bill, water bill, internet bill, food, and anything else that accommodates his lifestyle that was neatly packaged as a business expense. Basically, he flushes the toilet, the water used in that toilet bowl is marked as a business expense.
I don’t think he reported his gacha game spending anywhere on these forms.
And regarding his increased spending during bankruptcy proceedings: makes complete sense as addicts often increase their substance/ gambling use during stressful times.

I'm not sure if he actually specifically thought it out to that degree. I think he just made up a number and claimed it. But if he has to justify it to the court, which he will, he has maybe a couple grand a month in expenditures that he can't just hand wave away. So he'll have to explicitly claim it's a "business expense" somehow.

I think his main take-away from the meeting with the lawyer was that IF he had less than a certain amount of income then he could file for ch7. Then that is exactly where and how much business expenses he calculated he had. Add a few extra dollars for padding.
I am sure everyone from the creditors and the court have seen this many times before and will not be fooled by his shenanigans.
As he clearly works from his couch in his living room. I am willing to bet money that he is NOT claiming an office space in his house on his tax. They would send people from the tax office immediately to inspect the workspace and would have shut those claims down immediately.

He actually does have a dedicated "office". He does, properly (assuming he only claims the office space), get to claim that as a tax deduction.
What is the risk if he's "caught"?
Is it a case of just trying to qualify for C7 and not be totally fucked with no real downside if he does get caught or will there be a penalty of time kind (fines/jail/criminal record)?
If this is an attempt to get Chapter 7 and there was no real risk then it makes complete sense to lower the value of things he owns and and lie about expenses... But I can't believe that there won't be a downside to lying to a court?

I have no idea what I am talking about. But I am speculating:
I suspect the worst consequences would be that the Ch7 attempt would be thrown out and it would become open season to collect on him again from the creditors until he files for ch13.
The creditors probably don't care what happens to him, they just want their money, or as much of their money as possible and they don't care about anything else. Why spend time and money to meter out punishment? It does not bring them their money back.
I suspect there will not be any downside at all, except he has to re-file as ch13 instead. No one probably cares if he lied. They want their money, nothing else.
The big modulo is if he did some dodgy deductions on his tax returns. Then I could see him getting in real trouble.
But again, I am just speculating out of genuine ignorance. So treat my post as such.

If he claimed realistic numbers (I also am self-employed and work from home in a dedicated office; there are legitimate deductions for household expenses that pertain to the office but not anywhere near the amounts Phil is using) they might accept them, but his ridiculous totals will draw deep scrutiny.The IRS literally does shit like this if they've decided they're going to disallow something. Maybe you take it to Tax Court and maybe you win, but if they've decided they don't buy your home office deduction you're going to have a world of pain to deal with.
