It's freezing cold and rainy here, so I'm surprised things are improving so fast. I still only personally know one person who has died.

I haven't seen my grandpa (who lives in a local nursing home) in almost a year now - although there was a month or two last summer where they were starting to allow visitors again. The nursing home called Mom, and asked if they should vaccinate grandpa, and Mom said it was up to him. Grandpa mis-understood and thought Mom wanted him vaccinated and being an obstinate old codger he therefor refused the vaccine. He's had Covid twice anyway so he's probably fine.

北京市順義區人民檢察院以京順檢一部刑訴〔2020〕508號起訴書、京順檢一部量建調〔2020〕36號量刑建議調整書指控被告人黎潔犯妨害傳染病防治罪，於2020年8月6日向本院提起公訴並建議適用簡易程序審理。經北京市高級人民法院指定管轄，本院於2020年8月13日立案受理。因案情複雜，本院依法轉為普通程序並組成合議庭。庭審前，本院於2020年10月13日召集控辯雙方召開了庭前會議，就本案的管轄、迴避等程序性問題聽取意見並就擬當庭出示的證據進行了開示。本院於2020年10月15日公開開庭審理了本案。北京市順義區人民檢察院指派檢察官楊珺出庭支持公訴。被告人黎潔及其辯護人盛衝到庭參加訴訟。本案現已審理終結。

北京市順義區人民檢察院指控：

被告人黎潔與家人長期在美國工作生活。2020年3月初，黎潔出現發熱、身體乏力等癥狀，多次到當地醫院就診未見好轉。期間，黎潔的同事被確診為新型冠狀病毒肺炎。3月11日（以下均為當地時間），黎潔再次就醫時，醫院對其進行了新型冠狀病毒核酸檢測。在檢測結果未出時，黎潔決定回國治療。后黎潔及家人從美國波士頓乘飛機經洛杉磯中轉，乘坐國航CA988號航班回國。為順利登機，黎潔在登機前服用退燒藥降低體溫，通過體溫檢測。登機后，在航班要求旅客主動申報發熱等不適癥狀時，黎潔未申報，未如實回答機組人員關於疫情防控的相關詢問。3月13日，黎潔及家人抵達北京首都機場。黎潔於當日被確診為新型冠狀病毒肺炎，其密切接觸者63人被採取隔離措施。

公訴機關認為被告人黎潔的行為構成妨害傳染病防治罪，因具有到案后如實供述犯罪事實、認罪認罰的從寬情節，建議判處被告人黎潔有期徒刑一年，可適用緩刑。

被告人黎潔對指控事實、罪名及量刑建議沒有異議，認罪認罰且簽字具結，在開庭審理過程中亦無異議。

辯護人對指控事實、罪名無異議，辯護意見為：被告人黎潔主動如實填寫健康申明卡、主動和機組人員陳述自己情況，根據《關於處理自首和立功具體應用法律若干問題的解釋》第一條的規定，構成自首；其系初犯、偶犯，如實供述犯罪事實，認罪悔罪，故建議對其判處有期徒刑一年緩刑一年。

經審理查明：

上述事實，有證人洪某、桂某、孫某、趙某、呂某、張某、車某、吳某的證言，被告人黎潔的供述，司法鑒定意見書，監控視頻，調取證據通知書、調取證據清單、扣押決定書、扣押清單、運輸航空公司疫情防控技術指南（第三版）、運輸機場疫情防控技術指南（第三版）、海關總署公告、關於做好航空口岸新冠肺炎病毒感染的肺炎疫情防控工作的通知、防控疫情廣播通知、健康申明卡模板、關於一例新冠肺炎確診病例黎潔的初步調查報告及補充調查報告、病例個案調查表、關於一例新冠肺炎確診病例洪某的初步調查報告、出/入境健康申明卡、新冠肺炎流行病學調查表、口岸傳染病可疑病例醫學排查記錄表、病歷材料、病例進展報告、密接者一覽表、在京密接情況說明、3月13日CA988航班洪某密接情況說明、北京市朝陽區衛生健康委員會關於患者黎潔流行病調查的函、傳染病報告卡、內地居民因私出境證件簽發信息、購票記錄、工作記錄、浙江省等省市疾病預防控制中心的復函、受案登記表、指定管轄決定書、立案決定書、到案經過、電話查詢記錄、人口信息證明等予以證實，足以認定。

本院認為：被告人黎潔違反傳染病防治法的規定，乘坐我國航空器從境外回國時未遵守海關、民航部門提出的預防、控制措施，謊報瞞報病情、接觸史，導致60餘人被隔離觀察，引起新型冠狀病毒傳播的嚴重危險，其行為已構成妨害傳染病防治罪，應予懲處。北京市順義區人民檢察院指控被告人黎潔犯妨害傳染病防治罪的事實清楚，證據確實、充分，罪名成立。對於辯護人所提被告人黎潔構成自首的意見，本院認為，遵守疫情防控的相關規定、如實填寫健康申明卡、配合防疫人員的工作是疫情防控這一特殊時期每位公民的應盡義務，黎潔的相關行為不能體現其主動接受法律懲處的投案意願、不屬於自動投案，故不構成自首，辯護人關於自首的意見本院不予採納。鑒於被告人黎潔到案后如實供述犯罪事實、認罪悔罪，且自願認罪認罰，辯護人相關辯護意見本院酌予採納，依法對被告人黎潔從寬處罰並適用緩刑。據此，本院依照《中華人民共和國刑法》第三百三十條第一款第（四）項、第三款，第六十七條第三款，第六十一條，第四十五條，第七十二條第一款，第七十三條第二、三款及《中華人民共和國刑事訴訟法》第十五條的規定，判決如下：

被告人黎潔犯妨害傳染病防治罪，判處有期徒刑一年緩刑一年（緩刑考驗期限，從判決確定之日起計算）。

如不服本判決，可在接到判決書的第二日起十日內，通過本院或直接向北京市第三中級人民法院提出上訴。書面上訴的，應當提交上訴狀正本一份，副本一份。

The coronavirus may remain in people’s brains after infection and trigger relapses in patients who thought they had recovered, according to a new study published in the journal Viruses.

In the study, mice that were infected with the virus through their nasal passages developed severe illnesses due to brain infections, even after the virus left their lungs. In humans, this could explain why patients who appear to be over COVID-19 sometimes relapse and die.

“The brain is one of the regions where virus likes to hide,” Mukesh Kumar, the lead study author and a researcher at Georgia State University, said in a statement.

“That’s why we’re seeing severe disease and all these multiple symptoms like heart disease, stroke and all these long-haulers with loss of smell, loss of taste,” he said. “All of this has to do with the brain rather than with the lungs.”

The research team found that the virus was located in the brains of mice at a level that was 1,000 times higher than in any other part of the body. Viral loads in the lungs began to drop after three days but remained high in the brain on the fifth and sixth days after infection, which is when the disease became more severe.

“Once it infects the brain, it can affect anything because the brain is controlling your lungs, the heart, everything,” he said. “The brain is a very sensitive organ. It’s the central processor for everything.”

COVID-19 survivors whose infections reached their brain could also become susceptible to other serious medical conditions in the future, such as Parkinson’s disease, multiple sclerosis, cognitive decline and autoimmune diseases, he added.

“It’s scary,” he said. “A lot of people think they got COVID and they recovered and now they’re out of the woods. Now I feel like that’s never going to be true. You may never be out of the woods.”
