I read a news article about the prosecution of a writer who published an erotic book with kids (in Gaystralia). And it's some gay bullshit.
If no real child participated in the production of such material, why should it be banned?
"It breeds degenerates" is not a valid answer. All porn breeds degenerates, no matter how extreme it is.
What are the arguments for banning AI CSAM?
The production and distribution of CSAM victimizes minors featured in these materials. But AI CSAM production is victimless (if it's not a deep fake featuring the real person), just like the production of porn depicting 30 y.o. "schoolgirls".
How does American legal system deal with things like that? Is it protected by the 1st Amendment and why?
Inb4: no, I'm not a pedo

Solution
1. It harms the consumer by retraining their brain to find children, visually indistinguishable from real children, as sexually attractive.
2. Models capable of generating nude children are trained on child pornography which violates the human rights of the child.
There is no grey area here
if you are seeking CSAM That alone should be illegal
No need to argue about it being fake or AI what you need to look at here is intent.

1. If CSAM materials are used for investigation of pedophile rings and identification of victims, AI generated CSAM can be used to sabotage the investigation.
2. If AI generated CSAM is indistinqueshable from the real one, the latter can be distributed guised as an AI generated.
I wonder how production and distribution of an AI generated content depicting a crime is protected by the 1st Amendment in general. Not just CSAM but whatever crime can cross your mind.

Porn with "schoolgirls" and "incest" should be banned too but for some reason it's not. Same goes with animation and games.

It should be illegal, and by extension, lolicon.
BTW it was once considered constitutional for porn to be banned under obscenity laws, we can at least extend CP bans to include fiction (not lolita if you were thinking that)
