Like they got in an agreement to kill each other when something terrible happens? Or Barb kills Chris on his sleep and then proceeds to kill herself while Cole observes the whole thing, smokin a cigarette and doing nothing to then say something along the lines of "I'm glad I didn't have to do it myself"?
That's dark...
This is one of those goofy-ass things law students think about. But it's usually not something that dramatic. It's just that they die in a car crash together where you can't actually determine who dies first.
And then, the miracle of boilerplate happens!
Ta-da!
ARTICLE VIII: Simultaneous Death Clause
If my spouse and I shall die under such circumstances that the order of our deaths cannot be readily ascertained, my spouse shall be deemed to have predeceased me. No person, other than my spouse, shall be deemed to have survived me if such person dies within 30 days after my death. This article modifies all provisions of this will accordingly.
I think this is usually in a husband's will when the husband is in theory the "head of the household." Yes, that's very cisnormative and shit but hey, legal documents of people with assets sometimes accommodates reality.
That's from the basic sample will Findlaw has.
It's not all that common a situation, but common enough it's in form wills.
