Opinion. Because the image he is charged with by the State of Illinois, they know the name and age of the victim. Going by the statement the Illinois cop made, they got the person who took the photo of the child convicted already. Maybe the feds are holding back until the state is done? I think the "charged her" was a typo, eliminate the word "her" and the comma it makes a lot more sense as you see below. People don't always speak perfectly. Maybe the picture Daugherty downloaded of a 3-5 year old child having a penis shoved in it's mouth doesn't have a victim name. Or it was virtual child porn. But it still would be suffice to stop the search and get the second warrant.

"She is in contact with the federal side based on the agents that identified her and charged the perpetrator of taking the images and all of that"

Regardless, Todd Daugherty is a child pornographer of the highest degree.

It makes no sense whatsoever to charge him over an image that could potentially be argued wasn't in a prurient interest as opposed to one that is indisputably prurient.

The image from #1533 is the same case. The FBI is claiming in its warrant that was a boy, while the state and homeland security is saying it was a girl. I think the FBI agent who wrote the warrant mismatch cases, I know that agent does a LOT of cases at the same time and could have mixed up the cases up. The image stated in #1533 is according to the state and homeland security the image they are going after me for. BTW nowhere that I know in the state search warrant does it state to look for images, let alone child porn. Finally, the officer in #1533 was wrong, the child was actually older, in fact according to discovery she is over 18 now. The state was trying to make her younger than what she was.
 
There's no mistake, there's 2 different images described completely different. They got multiple (and perhaps 100s or more) child porn images on your computer.

You don't know that agent does a lot of cases at the same time, that's you again just making shit up, and it's irrelevant. Given that he's been an expert for 10 years, he wouldn't make that mistake.

There is no Homeland Security going after you. Yet.....

Plus you said the image was in a pdf and that the state was allowed to search documents... Tell me Toadie, what does PDF stand for?
 
I didn't say homeland security was going after me, I do know that the girl image IS the one they are going after me for, I also know that Homeland Security was involved in that girls case and this case. YOU are talking out YOUR ass because, you don't have the files I do.

Just think what happens if the DA or the judge rejects that motion, which still hasn't been written in 16 months.... You are dead set for prison. EDIT: You claim homeland security got involved.,.. But you also claim that picture isn't child porn that you are being charged with, if that is true, why would Homeland Security get involved in something that isn't child porn??

Oh, yes there is, 4 blocks north of where you live. Also one south of you less than a mile away. If you are found guilty, you won't be able to live with your parents anymore as you will be too close to one under the Illinois sex offender laws. So if you are convicted, even if you don't go to prison, where do you plan on living?

Even if you're not convicted, they are going to find out about you and perhaps lay a trespass on you?

Because for a number of months she wanted to get an expert for the image. I wanted to challenge the warrant she final asked someone in Washington DC and I was right. She got them to write the document and were waiting on it. We were also waiting on missing documents the feds and state had and refused to turn over in fact it took a year to get them.

How's it a technicality, general warrants are illegal in the United States and unconstitutional, have been since the 1700's. One of the reasons for the revolutionary war was general warrants and writs of consent and the reason we have the 4th amendment.

WE got an expert for the image, however, right now we are working on the warrant thing. but he is there waiting for us to use him, when and if the time comes. We are attacking a number of things in this case, not just fucking warrant. we also attacking the image and the constitutionality of the Illinois law.
