I had thought I could handle them but they seem to get worse and worse - the nightmares of being put in jail again. I thought I could handle the trama but it seems to be getting worse. This whole is a bad joke, I mean that lawyer of mine, I don't shit but waste time, and as for that judge, why kind of judge doesn't look at the affidavit and warrant to see if they had probable cause. No instead he takes the state (THE GROUP THAT IS LYING TO HIM) They didn't have probable cause and the search warrant was a general warrant! If this is how the justice system works I want nothing to do with or the state or country that represent it. When you have a lawyer that seems not to being doing anything and a so-called 'impartial juge' who isn't and seems to take the state word on stuff like weither they had probable cause, then you had that public defender who just sits there, is that JUSTICE. if it is then it's bullshit.

Secondly your statement is not quite true. it is true that if a cop goes by someone window and sees a pile of child porn in the open, that is plain view, you can't use that logic when computers, in fact the courts have stated that. Files are in folders and therefore not in plain view. To state their plain view mean that the protection that you get from the 4th amendment doesn't apply. Computer more protection than a car and a house because a computer and a cell phone can hold a lot more person information. It has more protection than a cop looking in your window.

Because of Illinois child porn law is more restrictive than federal law. Illinois will even throw children in jail over their law. There are actually cases where a 6-year-old went to jail for sexual assault. the sexual assault was him touching his 3-year-old sister vaginal. The case was overturned, but the state rigorously fought to keep the original ruling. There is a case of a twelve-year-old had nude images of his little sister. my point is there has been for years not just by me but others who claim Illinois law is unconstitutional because it too far.

Hell, Illinois wants to ban virtual child porn, despite the US Supreme Court and the Illinois Supreme court saying it is legal and constitutional. they want to have the power to go into people home to check if they have obscene material, despite the fact it is legal to view obscene material in the privacy of your home.

You're not going to get those sorts of pictures if you're not visiting sites with them. Cops can search a home without a warrant and I've and many people here have told you how. If you ever wonder why cops can be so nihilistic and disgusted even dealing with normal people, they have to deal with scumfuck retard perverts like Todd Daugherty on the regular. Cops have often lost all ability to feel anything at all.
 
according to the federal courts when it comes to computers and cell phones, you have to be very precise on what you're wanting to seize, and “the plain view doctrine may not be used to extend a general exploratory search from one object to another until something incriminating at last emerges.” The warrant they had was so broad in scope it was general warrant. Not only was a general warrant, but they didn't have probable cause to begin with, due to lack for proper investigation. The affidavit for the warrant was written by an officer who had only been a cop for one year, he has no expertise in computer crimes. the probable cause was merely the complaint they had received by the FBI, and neither one investigated. In fact, in both the FBI report and the police report, it was stated that "the Illinois Attorney General has a new policy to arrest someone for making a threat, so Daugherty is going to jail" this was before they even arrested me. They had already had it in their minds that I was guilty before I was even arrested. like I said that in the police and FBI report, that in discovery. They officer who wrote the affidavit also used a 2015 arrest which was dismissed by the judge because there was no threat, stating you're going to sue the police chief, city and state is not illegal or a crime. He also states that there were gun images in that 2015 case, however according to 2015 police report there is no mention of guns, in fact they couldn't find the thing, nor was it brought up in court. In fact, the state attorney didn't have the post, my lawyer brought it in, and it's labeled as exhibit 1. All the state attorney had was the police report.
