Chupp didn't strike anything from either side. In his order granting the defendant's TCPA motions, he simply said that he did not consider the second amended petition, which included the withdrawn affidavits. Lemoine actually wrote a letter to the judge weeks later asking him to rule on their objections to the second amended petition and strike it in it's entirety. He never did.

They're still going to have to argue it on appeal because the defense and plaintiff are both going to argue their respective motions to strike should have been granted, or that the court actually did grant them silently because Chupp wasn't at all clear what he was actually doing. By not considering it, did he mean he actually didn't admit it? Also, the sworn affidavits were actually withdrawn by the plaintiff.

So hes basically admiting the Huber and slatosch affidavits would kill the defense's TCPA.
 
aside from doubting anyone on KV has $170 lying around to start with, I have a feeling that no matter what evidence you show he's going to try to come up with an excuse not to pay up lol
