I'd much rather imagine karma biting FUNimation in the ass over this. Either you hate them for maliciously terminating Vic over false accusations, or you have to hate them for not doing something about these very credible true accusations a long, long time ago. There is no middle ground for them and it's fucking beautiful.

He still can't comprehend that the standard for malice for a non-public figure is reckless disregard for the truth, not knowledge of falsity. Knowledge of falsity only comes into play if Vic is declared a public figure. He's almost certainly not a general purpose public figure, and there's some good arguments against him being limited-purpose. And court hasn't made a determination on that matter, anyway.

But I find it delicious that even PenguinLie is pulling the knives out for Funimation.

Actually, there isn't any standard for malice in a claim of defamation of a non-public figure. It's only required to claim defamation of a public figure, and then, the standard of actual malice is knowledge of falsity or reckless disregard for the truth.

TIL. I had assumed that some form of malice was needed for defamation.

I can see why the public figure angle is so contested then. It's easier to not need to prove malice at all than it is to prove it.

So I'm guessing reckless disregard and knowledge of falsity are interchangeable in regards to malice?

EDIT: Maybe I'm incorrectly equivocating reckless disregard for negligence.

What the fuck are they banging on about? Who the fuck is using IP addresses (not that I think anyone's above such a thing) to dox anyone when at best it gives you a general area that's easy enough to get from Twitter posts and is useless for anyone behind a VPN. And who needs an archive file of anything when all of it is conveniently hosted here on the farms?

Not sure if this is "Sea Salt Mine" material, but this just looks like dumb decisions all around. SiH shouldn't have made a tier list about a community that he's a part of when they're supposedly cooperating towards a common goal, and DH shouldn't find it necessary to do a response to a video that was altogether removed by the creator (implying that he doesn't stand by the video).

RT though, Senpaishome is the typical 20-year-old knoweverything. He attacks anyone who doesn't outright agree with him, exceptional little hanger-on.
