Seems like it. Depositions were already done and at this point I think everyone knows what witnesses will get called. Barring some last minute shenanigans this may actually be happening.
You quoted a post in another thread, about a video game.

Needs a new poll. At the very least so people have another place to put their optimistic ratings.

So Mark is really going to trial with this huh

March 15th at 9:30 AM in Courtoom 1 at the Federal Court House in Austin Texas provided Waid doesnt try and gum up the works some more. The Court also has asked both parties if they could waive jury selection and just let a magistrate do it for them. So it seems the judge has decided Waid and Meyer have had sufficient time to sort this out outside court. Next step will be the jury questions and any other motions for excluding or including evidence.

Did we miss motions for summary judgement somewhere? Or have both Meyer and Waid decided skip that step?

I don't see them on the docket.

The latest order reset trial dates etc. but said the other dates in the scheduling order were still operative, so:

"All dispositive motions shall be filed and served on all other parties on or before September 28, 2020 and shall be limited to 20 pages.'

Apparently, they're going to trial.

Guess Waid is running out of money. Can't afford to jam up the works for another 8 months to a year arguing over summary judgement. That's what the pudgy fuck gets for spending 2 years arguing over jurisdiction. Meyer always wanted a trial anyway so its no skin off his back to get this in front of a Jury. He has a better chance of winning there anyway.

That was a really dumb waste of time and money. That's the kind of dilatory, vexatious bullshit that only makes sense if you have an unlimited war chest and really don't care how much it costs, so long as it costs the other guy even more.

All this wait will have been worth it if Waid ends up before a judge and he pulls his patented King Baby tantrums.

I bet you it was all Waids idea and not his lawyers. Its what he threatened to do to the people he stole the comic shop from. Bury them in unnecessary tedium and bankrupt them before this ever got to trial. Of course, he was so stupid he never considered such a strategy could bankrupt him just as easily as it could Meyer. Instead of blowing all the money on a Jurisdiction fight he should have spent it trying to get the case tossed on summary. The writing on the wall should have been when the court ordered depositions to go foreword to gather evidence for the Jurisdiction motions. That allowed Meyers team to collect all the evidence they needed for trial anyway. And to discharge any summary judgement motions should they come up.

It also used up the courts patience too, so any summary judgement was dead on arrival anyway I suppose. It would have still dragged things out more, which clearly is what Waid wanted. But also as clear can no longer do. The fuckwit should have just done the public walk of shame Meyer wants him to do. I cannot wait to find out what the price of his pride will be. A part of me kinda wants to take a vacation to Texas just to see it.

This. I really think he probably blew his entire wad on litigating and relitigating and re-re-litigating this dumb, doomed jurisdiction fight. It might have been worth it to get the defamation part of it tossed if defamation was even a really big part of the case, but it isn't.

I look forward to his desperate pleas for more funds while the entertainment industry is still cratered and everyone is distracted by the presidential election. His friends will not be doing well, and much of whatever money they have will have been given to people promising to use it to prevent the re-election of Bad Orange Man.

The sad tragedy of why so many trials never get much news attention. Who's really got the patience for this much foreplay?
Don't get me wrong, justice needs to be done right which can mean the legal system burns slow. But by the time something approaching a conclusion is reached Zack could have sired another child, seen it born and had it get to the age where it can actually appreciate how odd it is a guy called Mark Waid has a lawyer called Mark Zaid.

Honestly if this goes to trial in March, and its looking like it will, it will have taken 3 years. That is FAST by federal court standards. I was expecting this drag on until late 2022.

Why even go through with it? He cant have other people paying for this can he? Does he really think he will win?

He's not the one suing, he's the one being sued; he doesn't exactly have the option to just drop it. He'd either have to settle or go to court. And, well, he's a very prideful (and stupid) man who doesn't want to admit he did something wrong. Meyer would likely require some admission of fault on Waid's part as a condition of settlement, so settlement probably isn't an option he'd consider. So court it is, with all the money he's burning to do so.

I think it's safe to say that there's almost no way this is the more financially prudent decision. He could probably have settled this for under $100K and an apology, and he'd have to have spent more than that already, with still a trial (and a potential judgement) still to go.

Oh God, please let that happen! I can't wait to see all the salt form the Comic Pros when Waid gets forcibly escorted out of the courtroom by a bailiff who looks like he eats nails for breakfast without any milk, obviously

What is baffling to me is that there is no point this going to trial. The Defamation may be hard to prove but Meyer has him dead to rights on the Tortious Interference. Meyers attorneys are going to put the CEO of Antarctic Press on the stand and the guy is going to tell the Jury that Waid absolutely butted into his contract negotations with Meyer and threatened his business if he didn't scupper the deal. They won't even need to add any other evidence to it (but they will). Even an absolutely brain dead panel of normies would be able to agree Waid committed TI. The Defamation claim is just the cherry on top. I have to imagine Waids own lawyers are telling him this too. All Waid is doing is burning more money he does not have on a trial just so he can pay even more money to Meyer. But we are repeating ourselves by opining Waid is a very stupid man. Its just he's so very stupid we can't help but repeat ourselves.
