He is being sued for illegally trying to put people out of business, something he has basically admitted in deposition already after extensive discovery that, thanks to the "defense" so far, was allowed to happen even before a motion to dismiss. In fact, the tack of the "defense" literally led straight to the discovery.

Waid had mentioned 'the industry' a bunch of times in his first round of deposition, indicating that a lot of people in the industry hate DnC (Joeming also talked about the pushback being from the industry). Include Waid's 'bring him to he, this will go wrong if its the wrong guy threat' from 2017? to show Waid thinks himself Kingmaker and animosity towards DnC for a long time...
