Does anybody know how the jury in this case would be selected if it got as far as trial? Would they be selected from all over the Western District or would they be just be selected from the Austin Division, and given that a trial would probably be in Austin how much of a bias towards Austin would there be within the people willing to do jury duty there?
This is probably quite important; I imagine that a jury of average Texans would probably railroad Waid, and a jury of Austinites would do the same to D&C.

From FAQ for jurors in Western District.

How was I selected?
A random selection of names of prospective jurors to serve on grand and petit juries is drawn from the General Election Voter Registration Lists (“voter registration lists”) of the counties comprising each division. These randomly drawn names make up the Master Jury Wheel. Another randomized selection is performed for purposes of determining qualification for jury service. These prospective jurors are sent qualification questionnaire forms in order to determine their qualification for jury service. Individuals that are deemed qualified for jury service make up the Qualified Jury Wheel. A random selection of names is drawn from this Qualified Jury Wheel in order to summon individuals for jury service.

The Austin Division is comprised of 17 counties, covering 14,962 square miles, with a population of 1.6 million.

why do people think he would lose even if all jurors would be from austin? twitter is s just representing a percentile of the population, i highly doubt your normal democratic voter can not see the tortious interference commited by waid . or is there something i as a guy from the other side of the great puddle can not see or know about?

The problem isn't Democrats qua Democrats, it's Austin. (Democratic party membership is symptom here.)

Let me put it this way: if you have a 9 in 10 chance of getting a completely normal jury, and a 1 in 10 chance of a jury with the Addams Family on it, you'd be really worried about that 10% coming up.

Given all the loud crowing for Waid, I'm not going to be surprised if that stops if those people find themselves in the hot seat during discovery because Waid convinced them to slander Zack. Also the fact that the whole FTC violation is still technically on the table might mean this could still get even worse for Waid. Can't wait to see what will happen next

If Zack has a competent lawyer (he does) any twitter warrior will get excluded during the jury selection phase.

The FTC won't waste its time nailing some Rando comic pro. Now if Discovery unearths an email chain involving Waid and senior executives at Marvel that ties into this whole mess, they might do something. To Marvel though, not Waid.

all of the dumbass bullshit being posted about the Texas Federal Court system in this thread rules. please keep it up.

>Texas Federal Court system

There are Federal courts located within Texas, however they are not a Texas system. It is ultimately an extension of, as the word "federal" would imply, the federal government, AKA the national level.

[/pedantry]

Waid isn't just some rando. He has a lot of influence in the industry. I think the FTC absolutely would waste its time dealing with him.

He's just this guy, you know?

He doesn't personally set policy. His shitty behavior is not, by itself, a pattern of conduct by major industry participants like Disney.

Without a lot more, you don't have anything that makes it worth the FTC's time. That doesn't mean that information won't come out that might make collusive behavior by industry insiders look more likely to be a corporate practice, but that hasn't happened yet, just a few things that make you go hmm.
