“It is not a legitimate subject of public debate, whether or not it’s OK to be transgender or whether transgender people are real.”
Whatcott’s lawyer could not be immediately reached for comment.
The flyers Whatcott distributed described Oger as a “biological male” and a “transvestite.” They were distributed to residents of the Vancouver-False Creek riding in 2017 when Oger was running for office with the B.C. NDP.
Oger filed a human-rights complaint, alleging the flyers were discriminatory and hateful and targeted her identity as a trans woman. Whatcott denied the allegations, asserting that his freedom of speech and religion entitled him to publish his views on Oger.
In the ruling, distributed to lawyers on Wednesday, the tribunal judge ordered Whatcott to pay Oger $35,000 in compensation for injury to her dignity, feelings and self-respect. Whatcott was also ordered to pay Oger an additional $20,000 for his improper conduct during and before the hearings.
“(It) is really so encouraging ... to have the tribunal say you know you can’t argue that you are just commenting on a legitimate public issue because this is not a public issue. There is no debate about whether people are or should be transgender,” said Quail.

In my view, the Flyer is the modern version of a “whites only” sign. It is an attempt to block the doors of government with a message that the political realm is for “cisgender people only”.

This statement roused my suspicion, so I looked up the three members of the panel for the decision. Can you guess what physical trait they all have in common?

I only briefly skimmed the decision, so please inform me if I'm missing information, but I wonder how this decision affects pronoun usage when referring to "cis" people. Would calling Whatcott a woman be equally as offensive as calling Oger a man? Or would the legal repercussions of misgendering be applicable only to people who are discriminated against ("discriminated" being used loosely here) on the basis of sex or gender--so trans people and women? Or would misgendering any "cis" person be acceptable? Also, how is trans defined here--as a legal category or an identity? Oger, I assume, has changed his identification such as passport and birth certificate to call him female, but could he have won his complaint without documenting his gender change?

Why would Whatcott calling Oger a man because, based on his personal beliefs, Oger is a man, insinuate in any way that Oger is lying? If you say dogs can eat vegan and I say they cannot, neither of us necessarily has to be lying. Yes, one of us is wrong, but our difference in understanding of a particular factual issue does not impute dishonesty on either of us.

It does make me laugh a bit that the council decides this on the assumption that someone who saw Whatcott's flyer would immediately peg Oger as the liar. Not to flex on Oger, but if I ran for political office and someone spread flyers claiming that I was a man, I would not be the person that readers would think was lying. I wonder what sort of physical difference there is between Oger and me that would induce that difference of reaction? Mysterious!

I've been reading a lot of legal decisions (US, not Canada) recently, and the contrast between the delicate focus on language displayed in those and the random application presented here is almost humorous. In the case of United States v. Singleton, one of the court's main arguments hinges upon the precise definition single word "whoever" within a federal criminal statute and whether it is applicable to the government as an entity. Compare to this (LONG) decision, whose writer(s) casually conflate sex and gender in Whatcott's statements when it benefits their argument, and presents the above moronic argument that passing out flyers condemning a political candidate forces the candidate to "argue for her [sic] basic humanity as the price of admission to political life."

Yes, he can. The Vancouver Rape Relief center took the tribunal's decision to court and eventually won. It cost them over $100,000. A few years later to now, Oger's persuaded the city to defund it.
