My other favourite true crime podcast, The Prosecutors, have uploaded another analysis of Luigi's case, this time on the federal decision to drop the murder charge. It was a really interesting episode on the history of US law and why the charges were dropped; based on a decision made by late Supreme Court Judge Justice Antonin Scalia in Johnson v United States (2015), Luigi's charges were ruled as not reaching the federal standard as being a crime of violence. Under Johnson, a crime of violence is determined via the "categorical approach", meaning a crime can only be determined to be violent based on the legal definition of the crime as opposed to the material facts of the crime. Because the elements of stalking can be technically carried out in a way that doesn't require force, attempted force or even the threat of force, it does not constitute a crime of violence under current US federal law. The firearm charges that were dropped were essentially needed to piggyback off the stalking charges to merit the death penalty.

Brett and Alice explain that Johnson is highly controversial among lawyers and should be ideally overturned as it results in legal absurdities. Justice Garnett refers to the controversies as a result of the categorical approach in her decision as well. For example, kidnapping is obviously a violent crime, but because the act can be technically carried out in a way that's not overtly violent (e.g. trickery), kidnapping is not counted as a "crime of violence". This reasoning applies to cases where the kidnapping under consideration was violent. While Luigi's stalking of Brian resulted in his death via shooting, because any hypothetical stalking could be done without violence, the law must treat Luigi's particular stalking charge as not a crime of violence, hence Judge Garnett's decision. Brett and Alice also suspect that Luigi will plea given the failure of suppression in the federal case, though they also suspect that Luigi may use the trial as a political platform.

late to this discussion but she’s evidently more of a freak than initially thought… and to think i was certain the relationship failure was 100% luigi’s fault. it was probably him more than her, but regardless… she’s very weird. what strikes me about this comment of hers is that it doesn’t seem to hold much truth. popular high school jocks like pretty cheerleaders and kaitlyn is genuinely ugly (not surprising, since luigi gravitates towards unattractive women). this girl obviously thinks very highly of herself, and has a “i’m different and special and not built for average society” complex— same as luigi’s. no wonder they liked one another

You think Kaitlyn is ugly? Damn 😅 I agree she's no great beauty (I've met much prettier Chinese women) but I think she looks kinda cute in her Tumblr photo. You almost wouldn't think that she's a little goonette.

The blonde hair in the below photo doesn't do her any favours, but Asian girls of her type are obsessed with looking white for some reason.

I've noticed that the girls Luigi's been linked too (like Paulina) don't tend to be very curvy. Paulina wasn't beautiful either but she did look feminine, moreso than Kaitlyn in my opinion. Luigi has odd taste to me. Then again I think rich men tend to prefer skinnier women over the curvy big-breasted types as a general rule.

I also keked when Kaitlyn was writing about Anthony being an "older guy" when he was only about 2-3 years older, a pretty standard and insignificant age difference. Her bigger concern should have been being pumped and dumped by a dudebro jock and not him being two years her senior - how immature can you be? Lol.

maybe flat-out ugly is a little harsh, but definitely not beautiful. i’m not even implying her to be “pretty, but not my type” — more like i genuinely think she’s barely decent/very subpar looking… that i cannot imagine handsome and well rounded men being attracted to her. i don’t see the appeal whatsoever. funnily enough the only pretty women in luigi’s sphere (to me) are his sisters. i think they’re both naturally gorgeous

so i guess her claiming she always dates “top notch” men doesn’t seem plausible to me. then again men will also fuck a hole in the wall when given the opportunity, so what do i know?

paulina is actually somewhat ok with makeup imo. in the pictures from their homecoming or whatever i don’t think she looked too bad. luigi’s taste is very weird, but it’s true that he falls into the categorical “rich nepo boy who leans towards skinny and scarily petite asian women”

i havent kept up with this shit so i have no fucking clue who anthony is but my question is, why is she so open about her sexual escapades? why does she post and speak as if getting pumped and dumped by men on a regular basis is normal at all?

"Dating" might mean something very different to Kaitlyn than it does to us. Because she's promiscuous I wouldn't be surprised if men went out with her just to get their peepees wet before chasing women more on their level, and that's if her perception is even accurate to begin with. It's not uncommon for guys to be FwB or even date women they're not that attracted to; it's very odd for women to understand that, but it definitely does happen. I think women might suspect that a guy she has a one night stand with mightn't be that into her physically, but if he sleeps with/dates her regularly? He must be very attracted to her, which often isn't the case.

I agree that the Mangione girls are beautiful, especially Luisa. She's particularly stunning in my opinion.

Anthony was some scrote moid she dated back in 2019 for about four weeks, an experience she extensively documented on her Tumblr. I believe it's on the page before this. Basically he was some pornsick jock who joked about her being "fun-sized" and wanted her to "queef on command". She "broke up" with him and of course she had to write a stream of consciousness breakup post over some moid she messed around with for less than a month. She also dated another pornsick gamer boy who was unemployed and relied on his mother to clean up after him. They roleplayed DDLG and choking together. She certainly knows how to pick 'em, that's for sure! :story:

I don't think Kait is ugly per se. She has that warm face that he seems attracted to particularly in women. He loves Asian women, so Kait must've been catnip to him. If you've ever seen her prattle on in one of her videos, you'll see how silly and inconsequential her brain is, though. If I were him and thank god I'm not, I'd have chucked her out the window for just talking drivel for hours. My god.

Paulina's big appeal was her billionaire daddy. Her face is weird, but her body's passably cute. I've run across casual pics of her in the past that were taken at an angle and her face just sort of collapses into a Picasso like mess. So no, not attractive from some angles. However, I will give her credit in that she has a warm demeanor in some of her pics. But she works for fucking Palantir now, so she's horrible.

Weeg is due in federal court tomorrow to discuss scheduling the trial. KFA wants the judge to delay the federal trial to next year, since the NY judge set the state trial for June which is really soon they're hoping the state will reschedule for the fall if the federal trial is pushed back. No photos again since it's the federal court.
 
Luigi's federal trial has been delayed until October; voir dire will start on the 5th of October, and opening statements will be heard on either October 26th or November 2nd. Garnett expects the trial to last six weeks. Due to the federal delay, Carro has rescheduled the state trial to begin September 8th, as he said previously he would delay if the federal case was pushed back, depriving us of our summer entertainment but giving KFA and co. most of the year to prepare for trial. There shouldn't be any major developments (except the result of the state suppression hearing coming May 18th) until then. A federal hearing will be held on June 5th concerning jury questionnaires, as the bulk of the legal work in the coming months will concern jury selection and avoiding bias in Luigi's trial.

There was some legal kerfuffle concerning Avi Moskowitz, Luigi's death penalty specialist. While the case is no longer death eligible it seems the defence want to keep him on, and letters have been filed in the federal trial regarding this.

Here is the legal scheduling order in the federal case. Looks like the federal case will officially start on November 4th. If it lasts the expected six weeks, Luigi's fate should be wrapped up before 2027.

Luigi's haters as far as I can see are just MAGA supporters and men jealous of the attention he received from women, it's not much deeper than that. I think the average normie thinks what he did was wrong without hating Luigi himself; it's not like he shot a woman or went full Bolshevik on Brian's family.

While we're on the topic of nutty Luigi supporters, about a month ago Rolling Stone released a short film on various Luigi supporters. Surprise surprise, they'll BPD demons. Most are insane lefties masking their attraction to him with "philosophical" rhetoric, but one 57 year old biddy is filmed writing sex fantasies about him. She clearly doesn't know the lore about his broke dick.

I'm late to the discussion too but Kaitlin is no beauty queen. I wouldn't say ugly but she looks like any other Asian girl. Nothing special. But that's what luigi likes. And she does seem sweet, she isnt mentally all there but she knew that she got a guy that was way out of her league and that's why she kept pictures of them together and seems like she's not over him. But he is dumb to allegedly commit an act that will send him to prison for the rest of his life risking he will never see an Asian girl again. He didn't think this through.
