Loli is technically illegal under American law, people have even been convicted.
Its a gray area under American law, and the specifics vary by state, actually. Additionally, while people have been convicted, all those that were convicted have had some association with and/or had actual CP with them. The exception to this is Alaska, where the man convicted pleaded guilty, and thus there was no fight and as such no definitive legal basis for whether or not its legal or not. It can get someone convicted, but whether or not it'll hold up in court is another matter. And unfortunately people that do get convicted for just loli content just plead guilty instead of putting up a fight.

Its interesting to note however that major companies have published and are publishing uncensored lolicon content in the West. An example of this the re-release of Dance in the Vampire Bund by Funimation (its first release was censored), and another is the upcoming release of Kodomo no Jikan, a controversial manga about a teacher and an elementary school student who get into a romantic relationship with each other.
