If someone lacks the capacity to consent that means that the content itself should be restricted. Josh doesn't lack the capacity to consent as seen in the plethora of videos he's posted. He may not be a contributing member of society but he's not an invalid who is incapable of keeping himself alive. He's just not very good at it due to lack of practice.

I think the implications of taking a life would be damaging to his well being. Not necessarily anything legal, just the psychological toll that it would take. If we think his substance abuse is bad now then can you imagine if he's trying to drown out the death rattle of his ex with booze?

By your logic that assumes he released the videos himself. While he did record them he did not consent to their public release which is still revenge porn in the event that someone releases it publicly as a form of retaliation. By that same token, if he released it without Jessica's consent then he would be guilty of revenge porn. Both parties have to consent regardless of who recorded the video.

That's fuckin dark, I sure hope Cobes has his shotgun loaded up with some slugs or buckshot of that crazy BPDemon shows up again.
