Repectfully, it's not about what you would do. There can be good reasons for using their language when you go after them legally. It makes you look reasonable and accomodating. When it comes to law, better to be smart than angry.

OK maybe I can see why I as counsel might refer to Hambeast as "she" but certainly NOT "transgender activist."

The reason is to maximize the potential damages. A “transgender activist” would presumably be defaming Amy to a large group of similarly motivated people, as opposed to an unemployed transvestite troll. It suggests that JY would have a greater ability to lower Amy’s reputation in the eyes of society.

Secondary reasons: occupations of parties are often included in pleadings in BC; this is probably the best way of pleading the material fact rather than the evidence; and “she” is less likely to get a telling-off from a judge being scrupulously impartial (sort of how Cousineau bent over backwards to humour JY before the death blow).
