'Empire' star Jussie Smollett attacked in possible hate crime

Empire" actor Jussie Smollett was attacked in the early morning hours on Tuesday in what Chicago police are calling a possible hate crime.

Smollett was attacked by two people "yelling out racial and homophobic slurs" and "poured an unknown chemical substance on the victim," police said.

According to police, one of Smollett's alleged attackers also put a rope around his neck. Both fled the scene.

Smollett took himself to Northwestern Hospital and "is in good condition," police told CNN.

Later Tuesday, CNN's Don Lemon spoke to Smollett and a mutual friend who was at the hospital with the actor. Smollett confirmed the incident took place.

He was shaken and angry that an attack like this could happen. Smollett told CNN he fought back at the attackers.

"Given the severity of the allegations, we are taking this investigation very seriously and treating it as a possible hate crime," the police statement said.

Smollett has starred on Fox's "Empire" since 2015. He plays Jamal, a successful singer in the musical Lyon family. Like his character, Smollett identifies as gay.

"We are deeply saddened and outraged to learn that a member of our 'Empire' family, Jussie Smollett, was viciously attacked last night," a representative of 20th Century Fox Television and Fox Entertainment said in a statement to CNN. "We send our love to Jussie, who is resilient and strong, and we will work with law enforcement to bring these perpetrators to justice. The entire studio, network and production stands united in the face of any despicable act of violence and hate -- and especially against one of our own."

A representative for GLAAD told CNN the organization has reached out Smollett to offer assistance and support.

"Jussie is a true champion for LGBTQ people and is beloved by the community and allies around the world," a GLAAD spokesperson said in a statement.

I’m not sure. If you post something Chicago related and it’s not 100% woke, they dig through your post/comment history. There were several unflattering Kim Foxx / Smollett stories that were posted and one commenter kept insisting that they were from Canada and The_Donald.

Judge stands by decision to appoint special prosecutor in Jussie Smollett case

A Chicago judge Wednesday denied a request by Jussie Smollett's lawyers that a replacement judge be assigned in the former "Empire" actor's special prosecutor case, in addition to rejecting other motions put forward by Smollett's team.
Judge Michael Toomin also denied a motion asking that Smollett's lawyers be allowed to intervene and argue other motions during the court appearance.
That decision led to the automatic dismissal of a motion to release the grand jury testimony of Olabinjo and Abimbola Osundairo. The brothers were paid $3,500 to stage an attack on Smollett and take "advantage of the pain and anger of racism to promote his career," Chicago Police Superintendent Eddie Johnson has said.

Originally suspects, the brothers were cleared when prosecutors announced Smollett had orchestrated a hoax. They then testified against the actor.
Smollett's lawyers had hoped to use the brothers' testimony to reveal inconsistencies in their stories, as they are the only two witnesses in the case.

No timeline has been provided for when Toomin will select a special prosecutor.
Last month, Toomin approved the appointment of a special prosecutor to independently investigate the handling of Smollett's case to "restore the public's confidence in the integrity of our criminal justice system." The prosecutor is being tapped to review the decision by State's Attorney Kim Foxx's office to dismiss the charges against Smollett.
Smollett faced 16 felony counts of disorderly conduct, but weeks later prosecutors dropped the charges, with Foxx's office citing "Mr. Smollett's volunteer service in the community and his agreement to forfeit his bond to the City of Chicago."
The special prosecutor will have the authority to pursue charges for any crime she or he believes was committed during the investigation, Toomin said. The prosecutor can also choose to prosecute Smollett, the judge said.

The judge's appointment of a special prosecutor was in response to Foxx's withdrawal from the case following questions of potential conflicts of interest and the appointment of her top deputy, Joseph Magats, as acting state's attorney.
According to Toomin's ruling, Foxx did not have the legal authority to appoint someone with decision-making power. In the case of a formal recusal, Toomin wrote, the court would have been responsible for appointing a special prosecutor.
Smollett's lawyer, Tina Glandian, said at a media briefing following Wednesday's hearing that the actor's legal team would be appealing Toomin's Wednesday decisions.
Smollett is keeping busy and pursuing his passions, the attorney said, calling him a "talented actor."

Former US Attorney Dan Webb named special prosecutor in Smollett case
CHICAGO (FOX 32 NEWS) - A Cook County judge selected former U.S. attorney Dan Webb to be the special prosecutor overseeing the investigation into the handling of the Jussie Smollett case.

Judge Michael Toomin named Webb the special prosecutor Friday morning.

Webb gained prominence for his lead role during the Operation Greylord investigations into judicial corruption in Cook County. He served as special counsel in the Iran-Contra affair and was previously appointed by Judge Toomin in the death of David Koschman.

Smollett told police he was walking home early on Jan. 29 when two masked men approached him, made racist and homophobic insults, beat him and looped a noose around his neck before fleeing. He said his assailants, at least one of whom he said was white, told him he was in "MAGA country" -- a reference to President Donald Trump's campaign slogan, "Make America Great Again."

Several weeks later, authorities alleged that Smollett had paid two black friends $3,500 to help him stage the attack because he was unhappy with his salary as an actor on "Empire" and wanted to drum up publicity for his career.

The Cook County state's attorney's office charged Smollett in February with 16 counts of disorderly conduct for purportedly orchestrating the incident. A month later, prosecutors dropped all charges with little explanation.

Among the options available to Webb would be to restore charges against Smollett, who continues to maintain the January incident wasn't staged.

In his June ruling, Toomin suggested that the county's state's attorney, Kim Foxx, mishandled the Smollett case by appointing a top aide to oversee it after she recused herself.

Foxx had been in contact with a Smollett relative and was approached by former first lady Michelle Obama's one-time chief of staff on behalf of Smollett's family. Foxx explained at the time she was recusing herself to avoid "even the perception of a conflict" of interest.

In his ruling, Toomin said he had no problem with Foxx's February recusal but that it should have included a request for a special prosecutor. He said she had no right to hand it off to someone from her office, which he said amounted to naming her own special prosecutor.

Foxx has said Smollett was treated no differently than thousands of other defendants in low-level cases whose charges have been similarly dropped. Foxx also publicly wondered if her being black has anything to do with the criticism she has received.
