'Empire' star Jussie Smollett attacked in possible hate crime

Empire" actor Jussie Smollett was attacked in the early morning hours on Tuesday in what Chicago police are calling a possible hate crime.

Smollett was attacked by two people "yelling out racial and homophobic slurs" and "poured an unknown chemical substance on the victim," police said.

According to police, one of Smollett's alleged attackers also put a rope around his neck. Both fled the scene.

Smollett took himself to Northwestern Hospital and "is in good condition," police told CNN.

Later Tuesday, CNN's Don Lemon spoke to Smollett and a mutual friend who was at the hospital with the actor. Smollett confirmed the incident took place.

He was shaken and angry that an attack like this could happen. Smollett told CNN he fought back at the attackers.

"Given the severity of the allegations, we are taking this investigation very seriously and treating it as a possible hate crime," the police statement said.

Smollett has starred on Fox's "Empire" since 2015. He plays Jamal, a successful singer in the musical Lyon family. Like his character, Smollett identifies as gay.

"We are deeply saddened and outraged to learn that a member of our 'Empire' family, Jussie Smollett, was viciously attacked last night," a representative of 20th Century Fox Television and Fox Entertainment said in a statement to CNN. "We send our love to Jussie, who is resilient and strong, and we will work with law enforcement to bring these perpetrators to justice. The entire studio, network and production stands united in the face of any despicable act of violence and hate -- and especially against one of our own."

A representative for GLAAD told CNN the organization has reached out Smollett to offer assistance and support.

"Jussie is a true champion for LGBTQ people and is beloved by the community and allies around the world," a GLAAD spokesperson said in a statement.

There will be no solution within conventional politics. Rahm is being 'harsh' on Smollett solely to promote himself. Trump's FBI is more likely to further prosecute the nurses and police who are already under investigation for telling truths about Smollett, than they are to go after Smollett.

The Michelle Obama aide said that getting the case to the FBI would be a major victory for a reason, and this is that reason.

Accidentally accessing he file while trying to get someone else's is a very obvious excuse, and even if it did happen that way I would still fire them were I the hospital admin. Zero tolerance is dumb, but hipaa violations have to be punished, otherwise you might as well throw the whole thing out.

If anything should have indicated to the state prosecutor's office that they made the wrong decision, it's Jussie now coming out and claiming he's innocent and threatening to sue. For fuck's sake.

CHICAGO (CBS)–Jussie Smollett told reporters Tuesday he’s ready to “get back to work.” Meanwhile, Wednesday night’s episode of his show ‘Empire’ received the lowest ratings in the show’s history, according to TV Line.
With about 3.9 million viewers, ‘Empire’ took a substantial hit, dropping to the lowest number of viewers in the history of the series, according to widely-reported TV ratings.

FOX, the show’s home network, hasn’t said whether ‘Empire’ will be renewed for another season, and the show’s producers haven’t said whether Smollett would still be on the show if filming continues for a sixth season.
In a surprise move that sparked outrage at the Chicago Police Department and the Chicago mayor’s office, the Cook County State’s Attorney’s office dismissed the criminal charges against Smollett Tuesday.
How the scandal alleging he fabricated an attack with racial and homophobic undertones will affect his future in Hollywood is yet to be determined.
Speaking to reporters after he left the court hearing where his charges were dismissed, Smollett presented himself as vindicated.
“Now I’d like nothing more than to just get back to work and move on with my life,” he said.

IPBA Statement on Jussie Smollett Case Dismissal

The Illinois Prosecutors Bar Association serves as the voice for nearly 1,000 front line prosecutors across the State who work tirelessly towards the pursuit of justice. The events of the past few days regarding the Cook County State’s Attorney’s handling of the Jussie Smollett case is not condoned by the IPBA, nor is it representative of the honest ethical work prosecutors provide to the citizens of the State of Illinois on a daily basis.

The manner in which this case was dismissed was abnormal and unfamiliar to those who practice law in criminal courthouses across the State. Prosecutors, defense attorneys, and judges alike do not recognize the arrangement Mr. Smollett received. Even more problematic, the State’s Attorney and her representatives have fundamentally misled the public on the law and circumstances surrounding the dismissal.

The public has the right to know the truth, and we set out to do that here.

When an elected State’s Attorney recuses herself from a prosecution, Illinois law provides that the court shall appoint a special prosecutor. See 55 ILCS 5/3-9008(a-15). Typically, the special prosecutor is a neighboring State’s Attorney, the Attorney General, or the State Appellate Prosecutor. Here, the State’s Attorney kept the case within her office and thus never actually recused herself as a matter of law.

Additionally, the Cook County State’s Attorney’s office falsely informed the public that the uncontested sealing of the criminal court case was “mandatory” under Illinois law. This statement is not accurate. To the extent the case was even eligible for an immediate seal, that action was discretionary, not mandatory, and only upon the proper filing of a petition to seal. See 20 ILCS 2630/5.2(g)(2). For seals not subject to Section 5.2(g)(2), the process employed in this case by the State’s Attorney effectively denied law enforcement agencies of legally required Notice (See 20 ILCS 2630/5.2(d)(4)) and the legal opportunity to object to the sealing of the file (See 20 ILCS 2630/5.2(d)(5)). The State’s Attorney not only declined to fight the sealing of this case in court, but then provided false information to the public regarding it.

The appearance of impropriety here is compounded by the fact that this case was not on the regularly scheduled court call, the public had no reasonable notice or opportunity to view these proceedings, and the dismissal was done abruptly at what has been called an “emergency” hearing. To date, the nature of the purported emergency has not been publicly disclosed. The sealing of a court case immediately following a hearing where there was no reasonable notice or opportunity for the public to attend is a matter of grave public concern and undermines the very foundation of our public court system.

Lastly, the State’s Attorney has claimed this arrangement is “available to all defendants” and “not a new or unusual practice.” There has even been an implication it was done in accordance with a statutory diversion program. These statements are plainly misleading and inaccurate. This action was highly unusual, not a statutory diversion program, and not in accordance with well accepted practices of State’s Attorney initiated diversionary programs. The IPBA supports diversion programs, and recognizes the many benefits they provide to the community, the defendant and to the prosecuting agency. Central to any diversion program, however, is that the defendant must accept responsibility. To be clear here, this simply was not a deferred prosecution.

Prosecutors must be held to the highest standard of legal ethics in the pursuit of justice. The actions of the Cook County State’s Attorney have fallen woefully short of this expectation. Through the repeated misleading and deceptive statements to the public on Illinois law and circumstances surrounding the Smollett dismissal, the State’s Attorney has failed in her most fundamental ethical obligations to the public. The IPBA condemns these actions.

This irregular arrangement was an affront to prosecutors across the State, the Chicago Police Department, victims of hate crimes, and the people of the City of Chicago and Cook County. We strongly encourage our members and the public to review the National District Attorneys Associations statement on prosecutorial best practices in high profile cases.

He hired Mark Geragos (you know the not yet arrested partner in Avanetti's Nike Shakedown scheme!) so if he started with $500k, there's no way he's worth that now. Gerago's wants 6 figures up front.

Oh my personal favorite Fuck You to the State Attorney, the Judge and Jussie has to go to the Chicago PD. When Foxx got a Judge to order EVERYTHING sealed, the Police mysteriously responded to a FOIA request from the local CBS affiliate... in under 4 hours... by giving them the entire unredacted case file ... just minutes before they got the official notice of the Judges order. oopsie!
 
Personally, call it a conspiracy if you want I think that is indeed their intention. This whole "White supremacist everywhere" rhetoric is being pushed to try and cause a rise of White supremacy or at least optics of it so then they can propose a way to solve the White supremacy (which I bet would end up in violence) and would be caused by their own actions. I agree with that. It's the standard bully tactic. Threaten and belittle the person until they feel they have no choice but to strike back. It's so obvious, IMO. Charleston was exactly that. Unfortunately, some of the people reacting to being bullied there were fully exceptional.

The seemingly open-and-shut criminal cases against convicted pedophile Jeffrey Epstein and “Empire” actor Jussie Smollett, though over a decade apart, have led some legal experts to compare the two.

Epstein, who pleaded guilty to two counts of soliciting prostitution from minors, spent only 13 months in jail as a part of a now-controversial sweetheart plea agreement back in 2008. As a part of the agreement, law enforcement opted not to continue the investigation into other victims or alleged perpetrators associated with Epstein.

The plea agreement he received garnered scrutiny following a Miami Herald investigation. One of the prosecutors who brokered the agreement is current Labor Secretary Alexander Acosta.

A judge ruled the that the plea agreement Epstein received violated state laws because the prosecutors did not notify the victims prior to the agreement.

Some are comparing the sweetheart plea agreement Epstein received to the charges being dropped against Smollett.

Smollett, 36, was charged with 16 counts for his role in allegedly orchestrating a fake hate crime, but the charges were unexpectedly dropped Tuesday morning.

Smollett alleged in January that two white men attacked him in the middle of the night as he was walking home from a Chicago-area “Subway” restaurant. He told police that the men poured a bleach-like substance on him, tied a noose-like rope around his neck and shouted racist and homophobic slurs.

The Cook County State’s Attorney Kim Foxx communicated with Michelle Obama’s former chief of staff Tina Tchen and members of the Smollett family, which led to her stepping back from the case. She claimed to have recused herself, but her office released a statement Thursday saying she only “colloquially” recused herself.

Fox News obtained an internal email from Foxx asking assistant state’s attorneys to dig for examples of similar situations in which the charges were dropped.

The FBI is now opening an investigation into why the charges were dropped. Similarly, the Department of Justice announced last month that they are looking into how Epstein got his plea deal.

CNN legal analyst Laura Coates pointed out the lucky breaks both of them had in a tweet that reads, “While the topic of #JussieSmollett felony indictments converted to wrist slaps is on everyone’s, including @realDonaldTrump mind, can we also chat about the prosecutorial decisions about #JeffreyEpstein?” with a link to a Vox.com article about Epstein.

“Smollett may have benefited from celebrity justice,” Georgetown University law professor Jonathan Turley also tweeted. “Like the Epstein case, it is not clear if the problem was an absence of blind justice or of equal justice. What is clear, however, is that this represents a travesty of justice.”

Conservative pundit and The Daily Wire editor-in-chief Ben Shapiro tweeted in February, “If Epstein weren’t politically connected is there any doubt he’d be in prison for the rest of his life?”

He weighed in Tuesday on the charges being dropped against Smollett, saying, “Letting Smollett off the hook is a pure political calculation by Cook County. It is indeed that simple. The facts are in public view.”
