'Empire' star Jussie Smollett attacked in possible hate crime

Empire" actor Jussie Smollett was attacked in the early morning hours on Tuesday in what Chicago police are calling a possible hate crime.

Smollett was attacked by two people "yelling out racial and homophobic slurs" and "poured an unknown chemical substance on the victim," police said.

According to police, one of Smollett's alleged attackers also put a rope around his neck. Both fled the scene.

Smollett took himself to Northwestern Hospital and "is in good condition," police told CNN.

Later Tuesday, CNN's Don Lemon spoke to Smollett and a mutual friend who was at the hospital with the actor. Smollett confirmed the incident took place.

He was shaken and angry that an attack like this could happen. Smollett told CNN he fought back at the attackers.

"Given the severity of the allegations, we are taking this investigation very seriously and treating it as a possible hate crime," the police statement said.

Smollett has starred on Fox's "Empire" since 2015. He plays Jamal, a successful singer in the musical Lyon family. Like his character, Smollett identifies as gay.

"We are deeply saddened and outraged to learn that a member of our 'Empire' family, Jussie Smollett, was viciously attacked last night," a representative of 20th Century Fox Television and Fox Entertainment said in a statement to CNN. "We send our love to Jussie, who is resilient and strong, and we will work with law enforcement to bring these perpetrators to justice. The entire studio, network and production stands united in the face of any despicable act of violence and hate -- and especially against one of our own."

A representative for GLAAD told CNN the organization has reached out Smollett to offer assistance and support.

"Jussie is a true champion for LGBTQ people and is beloved by the community and allies around the world," a GLAAD spokesperson said in a statement.

I didn't even know Empire was a show until like a year ago

It's a somewhat decent show; think King Lear/Succession but with black people and set around a record label. Unlike Succession, Empire has way better pacing and the plot moves at a decent pace. Also there is some late 90s callbacks to the rap business, with the main lead being an expy of Puff Daddy. I binged the first season on a whim while I was sick with the flu but never watched anything beyond that so I don't know how the quality stood up after that season.
 
Fake punch to the face, fake slap on the wrist. I think it's going to be a bit worse than that. My guess is 6 months in the cage, but who knows. Still not enough. As other posters have pointed out, if it hadn't been for the Chicago PD and Smollhead's own imbecility, there would have been a lot more cruelty and death resulting from his nonsense being believed.

How many rapes happened? How many kids weren't removed from their shit parents? How many murders? How many people weren't stopped or caught because of that retarded faggot wasting police resources? That leaves aside all the little property crime shit, and the tainting of belief in legitimate claims of being assaulted.

His sentences should be maxed, and run consecutively. They won't, of course, but he was playing with an atom bomb there, and unquestionably caused a great deal of damage.

I'd love to see the hate-crime sentencing shit kick in, or more charges laid. Don't know how it works in Illinois.

Nothing. They have disowned him and he can not count on any "celebreity sentencing" or any hot-shots putting in a good word for him.

At the end of the day. It is a non-violent crime. I doubt that they will sentence him to prison for this. Because it is a non-violent crime and because the fact of him now being a convicted felon is severe enough punishment. But who knows, the shenanigans of trying to get a twitter mob send blm to the judges home makes things very much up-in-the-air

Nothing said in court or filed as part of a legal document is actionable in that way, they is considered 'protected'. (Otherwise people could get sued for advancing otherwise sound legal theory or defenses in court.) The trouble for Juicy and his attorneys is that they have made some claims about the brothers in other forums, press releases, tv interviews and the like. Those statements could be grounds for a suit, theoretically. Wether it's be worth filing is a whole different calculus.
Bussy probably still has some Empire money left over to squeeze out of him, so I hope the Rough Trade Bros take him to court.

That is one of the questions you have to ask when thinking about filing suit. It might not be worth the cash you'd burn to win the suit if you can't squeeze the blood from a stone. Then again, there are also some non-monetary things you can win, like corrections or apologies. There are some other remedies that might be meaningful.

What remedies? "Sorry I lied about saying I hired you to fuck my ass raw every night?" The Nigerians are going to go home, and tell their countrymen, "Yes, we fucked him in the ass. We fucked his little faggot ass prolapsed every single night, and gladly because he was paying us big stacks to do so." They may hate the gays, but they do love the hustle there.

His fucking hubris. He still thinks he'll just a get a light tap on the wrist and he'll be on his merry way, which may very well happen. Sure he's a very disliked fag on both sides, but to him he is Jussie Smollett the best actor in Jusstory and everyone else including family and especially us poors, are beneath him.
But if he gets a rough sentencing and the inevitable realization somehow kicks in, I expect a full blown meltdown that'll shake him to the core as his ego gets deflated slowly but surely.

Then again, his ego is bigger than the noose he wrapped around his neck that I dont know if itll phase him. After all, this is the same guy who pretended to be his brother when he got stopped by a cop for a DUI and talked about Empire being the highest rated show ever thanks to him while he was on the stand. His ego knows no bounds.

I don't think there's any evidence they can use to get him for that. Smollett being the genius he is has probably done something miraculous like left DNA samples for himself somewhere on the thing but since no police time was wasted on the letter since it was separate from the crime that was reported to the police and it's not played any significant role aside from giving Kiwis more fodder I don't think anyone's going to waste their time on it. Much as we'd all like to see that confirmed to be him too it seems unlikely anyone cares enough to investigate.

Count 1 accused him of telling responding Chicago Police Officer Muhammed Baig at around 2:45 a.m., some 45 minutes after the purported attack, that he was the victim of a hate crime. He said two attackers put a rope around his neck.

Count 2 refers to Smollett telling the same officer he was a victim of a battery, describing attackers beating and pouring bleach on him.

Counts 3 and 4 are when Smollett made the same claims but to a different officer, Kimberly Murray, later that morning, at just before 6 a.m.

Count 5 accuses Smollett of again telling Murray at around 7:15 p.m. that he was the victim of a battery.

Count 6 refers to Smollett reporting on Feb. 14, 2019, to detective Robert Graves that he’d been a victim of an aggravated battery. This was the count that Smollett was acquitted on.

So, no. He was never charged, though I do remember a fancy officer-style cop at a press conference saying that he sent himself the letter. They probably just didn't have the sort of slam dunk evidence that would be needed to nail him on it. Though, I think they found the magazines and locktite glue used to make the letter at the Osindoro bro's apartment. Also, the letter had crushed up aspirin in it, for bonus "fake anthrax" fuckery.

As far as I understand he comes from a wealthy family, and he had a moderately successful music career as well before he fucked it all up. I'd be glad to see him go broke and never work again, so hopefully he does get sued by anyone who has a case.

Report details state prosecutor’s ‘failure’ in handling first Jussie Smollett case

CHICAGO —
The initial handling of allegations that former “Empire” actor Jussie Smollett had staged a fake attack in Chicago represented a “major failure of operations” by the local prosecutor’s office, according to a lawyer who was appointed to review the case.

The 68-page report released Monday detailed multiple instances of false statements by State’s Attorney Kim Foxx and others in her office in 2019, when they first prosecuted Smollett before abruptly dropping the charges weeks later.

Some of her office’s actions may be violations of legal ethics, special prosecutor Dan Webb concluded, though he found nothing criminal.

Smollett, who is Black and gay, was recently convicted of lying to police in January 2019 about what he said was a racist, homophobic attack. Webb, who took over the case, said Smollett staged the attack to get publicity. Smollett is expected to be sentenced in 2022.

Webb released a portion of the report, including its major conclusions, in 2020. The full report released Monday documents interviews with Foxx, dozens of employees in her office, Chicago police officers and friends and family members of Smollett.

Foxx had recused herself from the Smollett case before it was dropped. She told Webb’s team that she was surprised when all 16 counts against Smollett were dropped, and that she believed he should have been required to admit some wrongdoing.

Foxx also said she believed prosecutors in her office “wanted to get this guy out of town” because of the media attention that accompanied the case.


Foxx later said in a media statement that the case was dropped just like thousands of other similar cases, which Webb concluded was not true.

“The fact that such a significant mischaracterization could be asserted without sufficient vetting ... is unacceptable for an office that must be transparent and maintain public confidence,” Webb’s report states.

Webb also found that Foxx improperly changed her public position about the strength of the evidence against Smollett. After calling the case against him “strong,” she wrote in a Chicago Tribune editorial shortly after the charges were dropped that securing a conviction was “uncertain.” That pivot was “false and misleading,” Webb concluded.

In response Monday, the state’s attorney’s office said it remains “steadfast that the office acted within its broad prosecutorial discretion.”

“A prosecutor’s discretion is as broad as any in the law, and differences of opinion as to how a case was handled do not signify an abuse of discretion,” the statement said.

Webb also pursued the investigation against Smollett, and a grand jury in 2020 indicted him on new charges of lying to police. A jury convicted the 39-year-old earlier this month on five of six counts of disorderly conduct, a low-level felony.

Smollett has maintained his innocence, and his attorney said they will appeal the conviction.


Judge Michael Toobin, who appointed Webb as special prosecutor, said the full report should be made public now that Smollett’s trial is complete.

In fairness the sentence where they remind us of his race and sexuality is also the one where they remind us he faked a racist and homophobic crime. Really knowing he is both black and gay is kind of relevant there for those who don't know who he is.

Not going through the 68 page document tonight but here's a fun overview. TLDR no actual criminal stuff proven but a lot of almost certain ethical violations and it's all being blamed on the prosecutors office, not external groups. Which provides additional context to Foxx refusing to be called as a witness in the trial because she could have shafted everyone involved fairly swiftly.
As set forth in this Summary Report, the OSP has reached five (5) final conclusions relating to the conduct of the CCSAO and three (3) final conclusions relating to the conduct of the CPD in the Initial Smollett Case. First, as to the CCSAO, the following are the OSP’s five (5) major final conclusions:
(1) The OSP did develop evidence that establishes substantial abuses of discretion and operational failures by the CCSAO in prosecuting and resolving the Initial Smollett Case. Specifically, the OSP concluded: • The CCSAO’s process and decision-making for resolving the Initial Smollett Case were a substantial abuse of discretion and represented a major failure of the operations of the CCSAO; • The CCSAO engaged in a substantial abuse of discretion and breached its obligations of honesty and transparency by making false and/or misleading statements to the public regarding the nature and reasons for the dismissal of the Initial Smollett Case; • The CCSAO engaged in a substantial abuse of discretion and breached its obligations of honesty and transparency by making false and/or misleading statements regarding State’s Attorney Foxx’s recusal to the public; and • The CCSAO engaged in a substantial abuse of discretion and breached its obligations of honesty and transparency when State’s Attorney Foxx made false and/or misleading statements to the public that she stopped communicating with Jurnee Smollett, Mr. Smollett’s sister, after State’s Attorney Foxx had become aware that Mr. Smollett had become a subject of the investigation.
(2) The OSP did develop evidence that may rise to the level of a violation of legal ethics by State’s Attorney Foxx and the CCSAO lawyers relating to false and/or misleading public statements made about the prosecution and resolution of the Initial Smollett Case. Under Illinois Supreme Court Rule 751, the OSP has no authority to make findings determining ethical violations by lawyers. However, the OSP will 3 comply with applicable reporting obligations as required by the Illinois Rules of Professional Conduct (see IRPC Rules 8.3(a) and 8.4(c)). Based on these reporting obligations, once able under Illinois law, the OSP will submit this report to the Illinois Attorney Registration & Disciplinary Commission so that it can do the appropriate review to determine if any ethical violations occurred;
(3) While the OSP did not develop evidence showing State’s Attorney Foxx was involved in decision-making on the Initial Smollett Case after she was recused, the OSP did develop evidence that she was provided with frequent updates about the Initial Smollett Case after her recusal;
(4) The OSP did not develop evidence that would support any criminal charges against State’s Attorney Foxx or any individual working at the CCSAO; and
(5) The OSP did not develop evidence of improper influence by any outside third parties in the decision-making by the CCSAO in the Initial Smollett Case.
Edit - I am still not going through it sensibly but skimming revealed this. They are all going to stab each other in the back over this.

Sixth, not only did the two CCSAO decision-makers—Mr. Magats and Ms. Lanier—fail to identify in their interviews with the OSP any change in the evidence, their offered explanations of the process and factors that led to the resolution decision differed in four significant and meaningful ways: (1) Who negotiated the terms of the resolution with Mr. Smollett’s lawyers? Mr. Magats told the OSP that Ms. Lanier handled the negotiations of the terms of the resolution (of which he approved). By comparison, Ms. Lanier told the OSP that Mr. Magats handled the negotiations of the terms with Mr. Smollett’s counsel. Patricia Brown Holmes, Mr. Smollett’s lawyer who primarily handled negotiating the resolution on Mr. Smollett’s behalf, told the OSP that she had initial discussions with Mr. Magats, who then relayed her to Ms. Lanier, with whom Ms. Holmes negotiated the terms of the resolution.
