'Empire' star Jussie Smollett attacked in possible hate crime

Empire" actor Jussie Smollett was attacked in the early morning hours on Tuesday in what Chicago police are calling a possible hate crime.

Smollett was attacked by two people "yelling out racial and homophobic slurs" and "poured an unknown chemical substance on the victim," police said.

According to police, one of Smollett's alleged attackers also put a rope around his neck. Both fled the scene.

Smollett took himself to Northwestern Hospital and "is in good condition," police told CNN.

Later Tuesday, CNN's Don Lemon spoke to Smollett and a mutual friend who was at the hospital with the actor. Smollett confirmed the incident took place.

He was shaken and angry that an attack like this could happen. Smollett told CNN he fought back at the attackers.

"Given the severity of the allegations, we are taking this investigation very seriously and treating it as a possible hate crime," the police statement said.

Smollett has starred on Fox's "Empire" since 2015. He plays Jamal, a successful singer in the musical Lyon family. Like his character, Smollett identifies as gay.

"We are deeply saddened and outraged to learn that a member of our 'Empire' family, Jussie Smollett, was viciously attacked last night," a representative of 20th Century Fox Television and Fox Entertainment said in a statement to CNN. "We send our love to Jussie, who is resilient and strong, and we will work with law enforcement to bring these perpetrators to justice. The entire studio, network and production stands united in the face of any despicable act of violence and hate -- and especially against one of our own."

A representative for GLAAD told CNN the organization has reached out Smollett to offer assistance and support.

"Jussie is a true champion for LGBTQ people and is beloved by the community and allies around the world," a GLAAD spokesperson said in a statement.

If the trial had been streamed it'd be easier to predict, but if I'm guessing I'd say Ineffective Assistance of Counsel, since his attorney fled the courtroom at least once in a sobbing breakdown after an objection was overturned.

I wish it had been streamed, I wanted to see that in 4K myself. I know Nick has a grift incentive to push for all trials to be livestreamed, but he's not wrong. It'd make things a lot more transparent and sometimes entertaining.
 
So, serious question to our resident Lawyers, if you were to try to appeal this what would your tactic be? I know they intend to try to appeal, so I am curious... what the absolute fuck they -could- try.

If the trial had been streamed it'd be easier to predict, but if I'm guessing I'd say Ineffective Assistance of Counsel, since his attorney fled the courtroom at least once in a sobbing breakdown after an objection was overturned. Also since his attorney accused the judge of making faces and 'lunging' at her leads me to believe they may not have the most by-the-book practice. I don't think it would go anywhere, though, even the Appeals court is probably pissed off at this clumsy attempt to use the justice system for personal ends.

I believe the civil procedure in Illinois is to file after sentencing, which takes place on Jan 27th so we might not know for sure until then.

It would basically require you to prove that your counsel was either so procedurally incompetent that they violated legal ethics, they were representing conflicting defendants (lol no), or they were actively working against your own best interests.

Best thing, In my limited opinion as a civil attorney who's never taken criminal procedure, would probably be to argue that the jury was tainted somehow, but even that's a stretch. Maybe if they find that the prosecution withheld exculpatory evidence, then maybe
 
I'm slightly more optimistic that Bussie won't just get a ruler slap on the wrist, because:

  • A special prosecutor came for his ass when the first dropped charges
  • He 's a celebrity, but he's not Idris Elba or Morgan Freeman. He is only known for Empire, and this. Most people probably have only ever seen the adverts for Empire and have never watched it - it's not like Stranger Things or some other TV phenom.
I'm seeing a bunch of leftist on Twitter seethe that a lower class kid defending himself from a pedo didn't go to jail but a Hollywood actor got convicted of faking a hate crime.

Whenever I saw ads for Empire, it was always Taraji P. Heson or Terrence Howard that featured... even that Precious chick got featured once or twice. But I cannot recall any of these ads featuring Juicy Bussy at all
 
Without access to the file and direct knowledge of the exact trial events it's difficult to make any predictions. This is why transcripts or recordings would be so helpful, but I'm not paying to pull them so I can make an informed and educated guess about where this shit show will go next.

It would basically require you to prove that your counsel was either so procedurally incompetent that they violated legal ethics, they were representing conflicting defendants (lol no), or they were actively working against your own best interests.

It's certainly a Hail Mary of an appeal but it's the most frequent and futile filing. Clients tend to blame their attorneys for their convictions, no matter the circumstance. Especially narcissistic idiots like Jussie that seem incapable of understanding that they gave the State all the rope and lumber needed to hang him at trial. Based on the extremely limited information I have, it's what I'd put money on if I had to bet.

Both avenues are going to be a non-starter, the jury question isn't going to go anywhere, the appellate courts don't give those theories much credence without some really egregious facts coming to light. Considering the nature of the offenses, the possibility of Brady material is slim - he could maybe try to attack the special prosecutor office and the way they drew the charges against him a second time, but I doubt it. His attorney already unsuccessfully tried a double jeopardy angle and failed. This case has already embarrassed the local political machine enough, so I doubt the appellate courts will open up the DA and prosecutor's office inner workings to further scrutiny. (They already barred having Kim Foxx called as a witness for example.)

Bottom line is that the appellate courts will likely want this to go away, and absent some bombshell revelation these convictions are sticking.

It’s not about a trial or a verdict decided in a white supremacist charade, it’s about how we treat our community when corrupt systems are working to devalue their lives. In an abolitionist society, this trial would not be taking place, and our communities would not have to fight and suffer to prove our worth. Instead, we find ourselves, once again, being forced to put our lives and our value in the hands of judges and juries operating in a system that is designed to oppress us, while continuing to face a corrupt and violent police department, which has proven time and again to have no respect for our lives.

In our commitment to abolition, we can never believe police, especially the Chicago Police Department (CPD) over Jussie Smollett, a Black man who has been courageously present, visible, and vocal in the struggle for Black freedom. While policing at-large is an irredeemable institution, CPD is notorious for its long and deep history of corruption, racism, and brutality. From the murders of Fred Hampton and Mark Clark, to the Burge tortures, to the murder of Laquan McDonald and subsequent cover-up, to the hundreds of others killed by Chicago police over the years and the thousands who survived abuse, Chicago police consistently demonstrate that they are among the worst of the worst. Police lie and Chicago police lie especially.

Black Lives Matter will continue to work towards the abolition of police and every unjust system. We will continue to love and protect one another, and wrap our arms around those who do the work to usher in Black freedom and, by extension, freedom for everyone else.

My recollection of IIAC in criminal cases is that you not only have to show that the lawyer's mistake could have caused a different outcome, but that it would have (prejudiced).

My guess is they're going to claim judicial bias. The defense would still have the burden of showing that it changed the outcome, though. The standard definition for "serious prejudice" from the USSC is "“improper judicial intervention ‘seriously prejudiced’ a defendant’s case when we find that there is a reasonable probability that, but for the error, the verdict would have been different. Moreover, in cases with multiple judicial interventions, determining the appearance of bias and the prejudicial effect of that bias generally involves a cumulative effect inquiry." I highly doubt they'd succeed, but the claims about the judge lunging are probably there to set the stage. It will let them bill a ton of hours railing about the violence racism inherent in the system.
 
I wonder if the Rough Trade Bros can sue Bussy in civil court for defamation? Being "falsely" accused as gay could get them killed back in Nigeria.

Nothing said in court or filed as part of a legal document is actionable in that way, they is considered 'protected'. (Otherwise people could get sued for advancing otherwise sound legal theory or defenses in court.) The trouble for Juicy and his attorneys is that they have made some claims about the brothers in other forums, press releases, tv interviews and the like. Those statements could be grounds for a suit, theoretically. Wether it's be worth filing is a whole different calculus.
