There was supposed to be another scheduling conference August 8, but it was quietly canceled without fanfare last month:

The same day, incidentally, that the District Judge ordered Greer to pay the fucking sanctions already and if he doesn't he'll have to pay another $500. But yeah, if the judges are so determined not to dismiss that they find some sort of excuse for keeping the case going, eventually there's going to have to be more meetings, discovery will have to resume/restart eventually with all its associated traumas, and so on.

I think that the court canceling that conference call is good evidence that they're working their way towards dismissing this case. If they were going to try to keep it going then they'd want to have that conference call to try to get things sorted out and back on track towards a trial. Canceling it feels like the court saying "Fuck it. Why even bother with the time and effort? This case is headed for the coroner." to me.

Eh, it was originally scheduled in December, at which time the parties and the court figured discovery would be wrapping up around now.

By last month it was clear none of that shit would be happening as scheduled, especially with discovery stayed (and this 8/8 call was to be in front of the District Judge, not the Magistrate). I can't shift my optimism circuits hard enough to believe that shitcanning this conference call meant anything but "Ffffffffuuuuuuuuuuu, this case isn't going anywhere, discovery is stayed, multiple open motions including possible dismissal and the plaintiff isn't obeying my orders, no point in re-scheduling until the other shit is handled."
 
The motion has to be served upon Mr. Hardin 21 days in advance. Given that the sentence was written on the 1st, it literally could not have been served on Mr. Hardin 21 days in advance.
Which at this stage is no doubt sanctionable as at this stage Greer should have a very good understanding on how sanctions work and how they should be served under the advice of the opposing attourney.

The tinfoil hat theory is that Greer is trying to run up so many sanctions on the docket that the Judge decides "Fuck it case dismissed everything is moot". But I wish Hardin a million granted sanctions as we might at some point approach the original amount Hardin was entitled to.
 
Pretty pathetic that Russ didn't even make an excuse for why he didn't pay the sanctions.

No "As the case of Walters v Higgins clearly says, I don't have to pay my sanction pending your approval of Hardin's sanctions!"

Just sheepish silence as he drops his request for sanctions and hopes no one notices or points it out.
 
I was, at least, hoping for the fast denial of his idiotic request for sanctions, it not outright dismissal. Three weeks since the deadline and the Judges have been doing fuck all.
I wonder what Greer is thinking of this lull in the case. It's ideal for him since he doesn't actually have to do anything but the case stays open indefinitely.

I'm optimistic the dismissal is incoming and the avalanche of plightsperging from Greee when it happens. Predict we'll see the "Motion to reopen the case or I'll kill myself"
 
I'm sure this was already mentioned but I'm reading thru his most recent filing again, and I love that he tries to pass the brothel meeting off like he HAD to attend in person. If I recall they even told him that he didn't have to show up, did they not?

Russ calling us mentally ill hurt my feelings though :(
They told him upfront they didn't think there was any desire to change the zoning and Greer thought he could woo them with the power point and his silver tongue. He really should have emphasized the lithium miners needing to fuck more in that presentation.

I regret to say im going to be behind on the thread tax, I honestly have nothing new to say at this time, except I hope Hardin responds this week, I can't see how ignoring this easy opportunity to show Russ again bring disrespectful of the judge 's court is a good idea.

Agreed, and if you look at the last two times Greer tried to invoke sanctions against him, Hardin moved immediately for an extension of time to reply -- in which motions he pointed out Greer's failure to serve the sanctions 21 days before filing them. (Of course one of those was not under Rule 11 so that didn't apply, but still.) If Hardin doesn't file, the judges are expected to infer that Greer didn't follow the rules, and I don't think they're going to make that inference. They're not looking that hard at the wording Greer uses and going, "Hmmmm, he mentions the July 1st filing, so if we do the math, that means he probably didn't serve Defendants properly under the rule." We can do that here, but the judges need to be told explicitly by Hardin.

That has a deadline of the 29th, might be good to let things air out a bit.
 
Greer honestly was not aware that the deadline had passed. The mentally ill trolls of kiwi farms continue to haunt and taunt plaintiff by harassing him under the guise of "conducting discovery" and "following legal procedure," and yet they bizarrely insist on blowing this eeny teeny weenie little innocent mistake out of proportion. I move that Matthew Hardin be disbarred and permanently imprisoned on Alcatraz.

It might happen next week or might happen a decade from now, but when this case is eventually concluded I can't wait to read Russell's anguished ranting.
