Governor Abbott Defends Texas’ Authority To Secure The Border

Governor Greg Abbott today defended Texas’ right to secure the border through the recent deployment of floating marine barriers in the Rio Grande River in Eagle Pass as part of the state's unprecedented response to America’s ongoing border crisis. In a letter to President Joe Biden, the Governor counters threats by the U.S. Department of Justice to sue the state over the barriers by pointing out that the U.S. Constitution grants Texas sovereign authority to protect its borders because the President refuses to enforce federal immigration laws.
“If you truly care about human life, you must begin enforcing federal immigration laws,” reads the letter. “By doing so, you can help me stop migrants from wagering their lives in the waters of the Rio Grande River. You can also help me save Texans, and indeed all Americans, from deadly drugs like fentanyl, cartel violence, and the horrors of human trafficking. To end the risk that migrants will be harmed crossing the border illegally, you must fully enforce the laws of the United States that prohibit illegal immigration between ports of entry. In the meantime, Texas will fully utilize its constitutional authority to deal with the crisis you have caused. Texas will see you in court, Mr. President.”

In addition to highlighting Texas’ right to defend its borders, Governor Abbott argues against claims that Texas’ floating marine barriers violate Section 10 of the Rivers and Harbors Act. Governor Abbott also included a copy of the January 8, 2023 letter he hand-delivered to President Biden in El Paso and the November 16, 2022 letter to the President that outline America’s current immigration laws President Biden must enforce to satisfy his constitutional obligation to safeguard American citizens and the sovereign authority of states to protect their borders when the President refuses to do so.
 
Between this and Alabama refusing to draw a second Black congressional district in defiance of the Supreme Court states are really testing the limits of modern American federalism aren't they.

It'd have been nice if he and the rest of the GOP could've taken the Chamber of Commerce's dick out of their mouths years ago (and not keep going back to it every time election season comes up).
 
It's still mealy mouthed though. His legal claim is he is stepping in to enforce the border because the federal government is refusing to uphold its constitutional authority under the interstate compact.

This is intense legal autism, but essentially foreign relations and wat not are an expressly granted federal power. However, the Federal Goverment can choose to not exercise its constitutional powers. In which case the power devolves to the State government under the 10th amendment.

Abbot is not arguing Texas has a Supreme right to defend the border. He's arguing he can do it because the Federal Goverment won't. It is a critical distinction.

I think he should leave the floating barrier up. Also dump a shitload of alligators down there. I would love to see gators death rolling beaners. Get big ones though.

That's anarcho-tyranny for ya. To the wicked shitstains who lord over us, the law is but a weapon, to be selectively used for political gain.

The only reason anyone would be opposed to "vigilantism" is because they benefit from rampant crime.
 
What pisses me off is that they KNOW there's a problem with our border and are punishing states for creating their own solutions to the problem. It's not even ignorance, it's pure malice.

I'm just amused that the spics are voting dem a lot less than had been anticipated. It's still a majority, but I think the left expected at least Texas to fall by now. I'd rather have Mexicans than, say, islamic turks like plagues western Europe, anyway.
 
How do those floating barriers work? They just look like a bunch of "Space hoppers" strung together. It doesn't seem like it would be a huge ordeal to climb over them, but maybe it's harder to climb up onto and over them when you're in the water.
