Even if they're dildos cast from actual animal penises, which I think they probably are other than the fantasy animal penises, there's probably enough there to be copyrightable, so I wouldn't call it frivolous if they just ripped them entirely.

But having seen the pictures provided, I can't see BD coming on top... I mean, coming out on top. This isn't direct copying, they'll have to demonstrate what is copyright-protected expression vs. what is a functional element of the underlying concept, and show that that is what was copied.
 
The main problem with furfaggotry is that they never seem to consider what others outside of their bubble might think about them.
Like, how can you look at a judge dead on the face who's been working for 25+ years in multiple other fucked up cases and explain about how the other furfag DESERVES to be sued because the balls, dick, or even urethra of their pony-dog-alien dildo is similar to theirs.
There are things that have to be 'dumbed down' to a general (normie) audience, I don't know how this trial will go without someone not pissing themselves laughing.

Are they remotely similar or a straight up rip? They certainly don't own the general concept of animal cock. You can copyright 3D models or sculptures directly taken from reality that are spatially identical to something that exists in reality, so you can probably copyright a dildo.

Tbh if I were to guess why they are suing since its obviously bullshit. Bad Dragon and a lot of these furry companies do this limited production run thing to drive up artificial scarcity. So you can only buy ANYTHING on their site during certain times and they max out their queue in an hour. This results in weird shit like that second hand market with furry dildo scalpers and knock off competitors. I'm guessing they have determined this challenges their scheme somehow.

TLDR: Furry dildo sales function like GPU sales during the crypto boom with scalpers

I hate to say it, but this thread is reminding me of the very short time I spent playing Second Life.

I was just wandering around at random, found this cool looking building someone had designed like a corporate headquarters. Seemed really neat, but it was in one of the mostly public areas of the game and was locked down like Fort Knox. Locked doors and weird elevators and all kinds of stuff, but nobody was around. So I took it as a challenge and horseed around trying to clip through stuff until I figured out how to get inside.

I'm not talking about what was in there, but it probably needs to be cited as evidence in this lawsuit I'm guessing. These people are freaks.

It seems more like a ploy for Bad Dragon to monopolize on the fantasy dildo market via legally shutting down any competition.
