Yes, "If you have a case, why did the judges not rule in your favor?" would have been a solid and sensible argument...70 years ago. But the 1950s have long passed. The judiciary of today doesn't care about rule of law or procedure or any of that. They care only about their whims and their accolades and rule based on how many sob stories and oppression labels each side can pile up. It's why jury trials are such a boon that I hope burgers hold onto with all they have.

At the same time, Ben, if you are aware of this, why are you fighting a battle you know you can only lose? No judge wants to be immortalized as the one that set the precedent to where a woman's nudes and porn can be legally leaked as long as she recorded them for profit. Do you know how much bad pr that would mean for them? They'd get their house picketed by hideous harpies bussed in by the ACLU and various foundation groups for the rest of their lives. Their name would be tarnished and all their peers would either distance themselves from them or look for ways to get them to retire or force them out some other way. No judge will ever rule in your favor so why are you expending all this energy sifting through case law to make a case that you know will never lead to a positive outcome?

To add onto this - let's say that sure, you both made it with the plans to make money. Were any formal releases signed? Did she ever give you anything substantial in the way of proof that shows she was waiving her ownership of the film as you both did this jointly?

Finally, let's even say that's true. There's also the interpretation of the law based on the word vs the spirit of the law. You may have made it to make money but let's all be honest, you released it because you were pissed and hurt and figured you'd set the bitch straight. Ok, well, with that intent, the spirit of the law holds valid here.

What the fuck are you talking about. the bitch gave the videos to random gamergators, in a fucked up conspiracy to conjure up a reason to have me arrested, by spreading the videos on the internet.

Why the fuck is she complaining about videos that were on the internet since 2011, when she gave the videos to these people to spread on the internet even more.

Why the fuck didn't she mention it in the divorce proceedings, and during these discussions with her divorce attorney, they conjured up a plan to wait until the law became enacted, so they could hatch this plan.

Why the fuck was the government paying for a government employee, to act as her divorce attorney, and create some sort of plot to spread the porn on the internet after the law was enacted?

I was dumb enough to skim through this sped's post history and I didn't see any mention of something anyone who has acted/modeled/been recorded is very familiar with: a release form. If there was one, this idiot would not be going, 'muh copyright.' Also seriously pressing X to doubt on the getting shot from ROTC story. Cadets rarely are allowed actual firearms and if they are, it's under strict supervision by your "battalion's" leadership. I am completely blanking on the word, but it's when ROTC cadets sign the dotted line and actually are in the military and receive the official rank of cadet (a circle on the rank patch), an official military ID, and signed the contact to be in the military after graduation and do that leadership course in Washington during the summers. If you didn't do that, you were just going to use those cute little blue plastic pretend rifles. Not to mention, if you were shot with an M4 or M16, you would have EXTENSIVE eye damage beyond muscle damage. You have strabismus and took ROTC as a college course, it's fine to admit it. ROTC is basically military LARPING/day camp and was a joke for people who enlisted prior to signing up for ROTC, so it's no big deal to say it wasn't your thing. Further, if you were that-word-I-can't-remember-because-ROTC-was-cringe, the military would have given you $$$. If you were injured as a civilian, oopsie. Not their fault.

Kids with strabismus have to have multiple surgeries sometimes, and surgeons will eventually tell them no because how many times the muscles were operated on. It sucks, but a fake story about being shot in an eye with no further signs of scarring or injury is just dumb. Stolen valor isn't cool.

TL;DR: You're full of shit on so many levels.

That's not going to prove jack shit. You can have surgery to correct straight business as a child and have your wandering eye return as you age and your muscles develop throughout puberty. Post pics of grisly eye injury. The military loooves paper trails, so the injury had to have been hella documented. Post pics of that instead.

Edit: Lmao, you can see exotropia (eye going outward) in your eye as a kid.

well, if the argument was that the regulation was based on preventing "something to be known", thats automatically in the content based speech categories that makes the statute unconstitutional. The mental backflip the state relies upon is comparing the statute, to a property theft statute. That is why I have to use the copyright preemption statute to negate their theory of intellectual property crime rather than a speech crime. If the state drops this theory, and no longer supports it, then I drop my counterargument, simple as.
