The complaint itself probably explains why they're suing and the insurance company isn't a party.It's very, very rare for someone with insurance to be sued after an accident since it's the job of said insurance company to settle everything and make both parties happy. I can't think of a reason otherwise, they even cover the other party's deductible if it's determined they weren't at fault.

Nah you go after the insurance company first if you can because theyre the ones with the deeper pockets, and more likely to settle than fight, just to cut their losses.NAL but I think that you would sue the individual and then the insurance company would step in and provide legal support and pay for anything that is covered under the policy, however that almost never gets to court.
I'm not sure if this applies the same in the US as in Canada, but so far as I know nitrous oxide wouldn't prevent driving but having a heart condition serious enough to require it would.Correct me if I am wrong, and I might be, theres just way too much happening now, lol. Wasn't Ralph driving home from his trip to Vegas where he had had a "cardiac episode" right before flying home and receiving nitrous oxide? Wouldn't that be something that could inhibit his ability to drive?
My bad, I was incorrect on the chemical. It was nitroglycerin. I did some digging and yes, the timeline is correct, heart episode, hospital, nitro, cross country flight, car crash. Like was said above. Ralph likely only had state minimum which in VA is only 20k for property and 25k for medical. If thats the case then the insurance company just paid out those maxes and the guy has to sue Ralph directly for the difference.Interesting to note Ralph's insurance company isn't listed as a defendant.
So this means the guy is sueing Ralph personally, right ? I would think if insurance didn't pay, they'd be listed as a defendant. But I don't know I've never been in a court being sued before.
