had the attack been entirely unexpected I'd feel different about it (and i imagine the courts would too), but the guy's intent wasn't to start a civilized debate or whatever, it was to make the guy aggressive, and to do whatever he could to make the guy more aggressive without throwing the first punch.

if the guy had pulled a knife on him, that'd be a different story.
