To prove it conclusively, they would almost need a dementia diagnosis prior to the rape, because even if Barb is demented now (something not proven and she is apparently still at 14 BC living on her own with or without assistance), the defense could argue she wasn't then, and was entirely capable of consent.
Incest is a repulsive sex crime, but legally not actually that serious. The justice system is more used to the opposite example of a parent raping a child, and that is treated much more seriously. Plain old vanilla incest between two adults is at the very low end of the sentencing range.
In fact, it is entirely possible Chris spent even more time in jail than a normal incest defendant would have if found guilty of a similar offense.

I would generally assume malicious intent and or/self preservation on the part of people who pretend Chris is a woman. By malicious intent I mean they KNOW troonism is bullshit but feel the need to defend every instance of self id because they know if people are allowed to question troons AT ALL their entire ideology will eventually be exposed for what it really is.

It's both troons and people who have no fucking idea who Chris is, and are too lazy to even do a google search as to why this hideous neanderthal is suddenly popping up in everyones feeds.
