The first clause in the second amendment has kind of been ground for contention..a big question is it functional or preambulatory

SCalia had a neat take (even if it was a side step , it was a brillinat one) in IIRC Heller that the clause informed but didn't restrict
(the preamble has been used to try to say it's a collective right)
Much of the reasoning in Heller was lifted directly from The Commonplace Second Amendment by Eugene Volokh. In fact, they directly cite this work for the specific distinction between purposive and functional language (and there are other citations to other Volokh works). This isn't unique or particularly novel reasoning. For instance, the preamble of the Constitution itself is generally not citable as itself granting rights. For instance, one can't sue demanding "the Blessings of Liberty." However, the rest of the text of the Constitution is read in light of the purpose of establishing such things.

It is well worth reading if you are interested in the background of legal scholarship that led to the Heller decision, which came as a shock to many, although it shouldn't have.

at abt 45:00 john starts talking about his new entertainment system being a safety feature because if his phone is anywhere near him he feels "instinctual need" to check "twitter or whatever" on it. Wrong word John, the word he's looking for is addictively he's a twitter addict.
He, by his own admission would check his phone while driving if he didnt have the carplay system.
OTOH that ALSO means John is still checking messages while driving...just hands free

The "militia" as contemplated in the Amendment would have been every able-bodied male.
US code still defines the militia as every able bodied male between 17 and 45, and female members of the National Guard. Which is why grabbers ranting about "herp derp, but youre not in a militia" is hilarious.

I'm not sure about the full history of it, but the current statute indicates it was passed in 1956.

I believe the last substantive change was adding females who are members of the National Guard, with most of the changes subsequent being renumberings and formatting changes.

The thing about the main gun isn't even necessary if you buy a license for it. Which would probably be trivial for most tank purchasers.

I think the main legal restrictions you'd run into with a tank is its street legality, you can't really drive it anywhere except on private property in most localities. I'm sure as a member of the local militia you can get some kind of waiver if your piece gets called up.

edit: It's not just "red" states like Texas either, there's huge amounts of tanks in private hands in a hard blue state like California. Just looking up if there were any state restrictions I found at least three separate estate auctions selling 100+ tanks in the last decade for California.
