IThat said, murder 1 is a crime of intent, of premeditation. It would only fit here if that dumbass went to the guy's door knowing she was about to kill him or intending to commit a crime (robbery, etc). Voluntary manslaughter, on the other hand, is a perfect fit for killing someone in the heat of the moment or because you're a drunk fool, etc. But Wu buys (or pretends to buy) into the idea that the law doesn't matter except as it can be used to punish the white oppressors and 'restore justice' (i.e. blood reparations). Imagine this idiot in charge of any governmental lever. She'd be more Trumpian than Trump.

Just for a reminder, here are the lay definitions of Murder 1/2/3(manslaughter) and involuntary manslaughter
  • First-degree murder: Premediated Murder, Murder for Hire. Any intentional murder that is willful and premeditated with malice aforethought. Felony murder, a charge that may be filed against a defendant who is involved in a dangerous crime where a death results from the crime, is typically first-degree.
  • Second-degree murder: Any intentional murder without premeditation, but with malice aforethought.
  • Voluntary manslaughter (AKA third-degree murder): sometimes called a crime of passion murder, is any intentional killing that involves no prior intent to kill, and which was committed under such circumstances that would "cause a reasonable person to become emotionally or mentally disturbed".
  • Involuntary manslaughter: a killing that stems from a lack of intention to cause death but involving an intentional, or negligent, act leading to death. A drunk driving–related death is typically involuntary manslaughter. The "unintentional" element here refers to the killer not reasonably intending for a death to result from their intentional actions. If it can be argued a killer should have reasonably expected their actions to result in a death, that is regarded as malice aforethought, making it second degree murder.

(Some states include other circumstances besides those listed (Killing a witness to a crime or a police officer is often an automatic upgrade to Murder 1; being an accomplice to a murder will usually get you a murder charge one degree lower than the crime itself, whether the definition fits the crime or not). Some states have a level above First Degree that is Capital Murder, which is First Degree Murder that can carry execution as a punishment.)

While "Mistakenly breaking into the wrong apartment and shooting the legal occupant" is kind of fucked up, it doesn't meet the bar for murder. The officer didn't think "Holy shit if there is a black man in my apartment tonight, I am going to shoot him and keep shooting until I'm sure he's dead", and she didn't intend to enter the wrong apartment and shoot the occupant. Texas doesn't have a Murder 3, only manslaughter, so there you go.

Despite what activist federal judges say, you can't just arbitrarily apply the law. You have to follow what's on the books.
Now, if you want to amend the code such that "Killing someone in their lawful residence immediately upgrades the crime to murder" go right on ahead. But 1) its too late for this crime, and 2) I can't WAIT until that amended law is used on the next BLM poster child.

Speaking of liberals not thinking things through, here's the other fun thing to consider:
If convicted, there is a wide range of sentences she could be given. Unless the prosecution SEVERELY fucks up, or her defense team does a hell of job, she's probably going to be going well towards the heavier end of the scale because.

The sentencing guidelines for Involuntary Manslaughter in Texas top out at 20 years.
In the liberal socialist utopia of Sweden, a "life sentance" for murder maxes out 18 years - so in Texas you can do more time for a manslaughter than you would do in Sweden for a premeditated gang-land execution.

Where did all the limp-wrists calling for sentencing reform run off to? I keep hearing we need to make our justice system more like Europe's, and I think they should calling for minimum sentencing for this poor, oppressed minority.

9/11 sperging always puts me deep into A-logging territory, so I'll restrain myself to this single observation:

Holy shit. That's a jaw-dropper. He actually believes he's a leader. And an exemplary one. He has zero clue what a leader, or leadership, consists of. Failure of leadership -- being able to effectively work with and inspire his teams -- was a huge part of why GSK and his political campaign cratered like rocks thrown at earth from the moon. John seems to think that Steve Jobs was the Best Leader Evar and that modeling himself on Jobs's autocratic style would work for him too. Except that Jobs was canny, had vision and was able to get people to buy into his vision to the point they'd overlook or forget what an asshole the man was. Also, he got results.

All John got from observing this successful hu-man Steve Jobs was "A leader tells people what to do like God Hisself and if they don't do it to his satisfaction, hellfire shall rain down and the gutters will flow with the blood of the unbelievers."

The results speak for themselves. Dear John, please point us to the praise written about you by former workers and associates with firsthand knowledge of your most excellent leadership. You've got nothing.

It would be like a more cringeworthy extended version of that hitchhiker scene from the original Texas Chain Saw Massacre
 
Glad to see leading political expert and future MA-8 congressman Brianna Wu spent the entire day ignoring 9/11.

If this were anything but a giant scam, Brianna would have gone to a local event for a quick snarl pic and some awkward handshakes. She’s always quick to talk about how much she’s learned from the first run, but she doesn’t make the minimum effort to make her scampaign look legitimate.

Bush did 9/11 with moonrocks. United 93 didn't crash, it was hit by a stray rock fragment. He then made Osama bin Laden carry out attacks on other Muslims, or Bush said he'd moonrock every major middle eastern city. That's why he was so interested in the moon, he wanted to get up there and install a larger moonrock launcher and hold the world hostage like a bond villain!

Republicans are the real terrorists. Christian terrorists who have weaponized the moon.
