Devyn Cousineau has awarded $30,000 to a nonbinary server. The case is supposedly about "misgendering". But it sounds more like someone who thought *she* should be exempt from the sexism all the other girls just have to put up with. She didn't like being called sweetie, honey, etc by a co-worker, basically. And became a huge pain in the ass about it.

The server was represented by Adrienne Smith, who spoke out in the media in defense of Yaniv.

 
Unrelated but people that flirt with waitresses are creepy as fuck, the same for people that refer to random woman as "sweetie", doesnt exactly help that a lot of chains are leaning into it as well.
 
That was a poor judgment. I don't know anything about Canadian law, so won't comment on the practicalities, but in a moral sense it's extremely weak and is likely to set all sorts of destructive precedents.

The HRT is the lowest level of Canadian law. It's very everyone-gets-a-trophy -- notoriously lax and biased in favour of the person complaining, low awards. The judgement can be appealed by asking the Supreme Court of BC for review. From there it enters the regular court process -- BCSC, BC Court of Appeals, Supreme Court of Canada.

It's one of those cases where the manager has shot himself in the foot by: Flirting with the dangerhair and nicknaming them, being honest about the harassment, and firing them for not fitting in.

Which is essentially how most people run afoul of these harassment laws.

Honestly sounds like one of those people that live off these payouts. They get jobs where they know they won't be a fit for the culture and then they cash out through the HRT

Wow! Very stunning and brave! I'm so glad this person got a payout! It's really great when my friends child is not watched properly at daycare and ends up brain dead and taken off life support before she's even in school, and the Crown doesn't give a shit. But I mean, the waitress def deserves the money! I'm not pissed off at all!
 
The decision says bar manager Brian Gobelle was particularly hostile, repeatedly and persistently referring to Nelson with she/her pronouns and with gendered nicknames like "sweetheart," "honey," and "pinky" — a reference to their pink hair.
Honestly, can’t say I blame her. This is straight up harassment. Wish the other girls sued.

They explained: “We don’t know who’s walking in the door.Wouldn’t it be kind of us to not assume anything about them?”. For example, instead of greeting a group of guests with “hi ladies” or “hey guys”, they suggested that staff could use words like“folks”or “friends”, or skip collective pronouns altogether.”

One CERTAINLY doesn't want to create the impression that one has the slightest iota of sympathy for these utter assclown "NBs" nor tolerance for that Nazi Clown Carnival Canada calls its Human Rights Tribunal--but yeah.
 
Claiming "non-binary" should just be a sign that someone wants special attention because they didn't get enough as a kid. You will never not change my mind because of cases like this with "non-binary" aposematism haired idiots doing everything they can to cash out on victim buxx.
