The phylactery is not free. It is in fact quite expensive. Don't let the authorities know or you could end up with felony larceny charges. And if you're using the lich contained within the phylactery to conspire with your confederates to commit crimes across state lines they might actually drop RICO charges on your ass and the lich is going to snitch.Liches are undead and thus dont have human rights
