This is not a debt but damages. Not sure on the full specifics but I believe this is the start. This is in small claims court and she is claiming $5,000+ in damages. This is the smart move here as it would be easier to prove without having to pay for a lawyer. If this has more legs to it, then she can advance this to civil court with a lawyer to go after pookie for more money

It might be the smart move. Just take a default judgment in small claims court, pay Tammy between 5-10 thousand, and just not talk about her anymore

There's plenty of lolsuits in gorl world, if you search the haydur nation thread there was a lawsuit between a handful of them for repeatedly claiming another reactor is a pedophile.
 
I'm just now catching up on the thread, but y'all will never get me to hate Aunt Tammie. The writers have really outdone themselves and her character has really breathed new life into this season.

If this goes to court, I hope that some intrepid gorlworld reactor will report live for us like FFG did with Nader's court case. All that matters is that SOMEONE FINALLY LISTENED. I'd hoped it would be a reactor, but I'll take the trashbag aunt.

Hambutt FINALLY has to get up at 6-7AM, PUT PANTS ON, and Shoggoth to a courthouse. Hoping the courtroom is on any floor but the ground floor.

I wondered if Tammy would go this route. The chances that Amber will rebuff hiring a lawyer and dealing with this inconvenience, at all, are high. The chances that she will not want to show up to court dates and testify to things she's done and said, under oath are also high. She cant just, "Thanks for the moneyyy" her way out of answering things she doesn't want to. She may also ignore it, knowing there is very strong chance a watcher or Tammie, herself, may get unfiltered vids and photos of her to share with the class, since they know where she will be and at what time. All of which could result in a default judgment. Easy money for Tammie.
 
Tbh I had a feeling when Amber did those 2 mini lives and then came back 2 hrs later with the “I’m leaving” live, I could tell by her body language and how she was acting that she knew she fucked up. I remember thinking that Amber probably knew that Tammy has either sued people in the past or that she follows thru with what she says so her threatening to leave was her childish way to get out of it. It kind of reminds me of when little kids get in trouble and they pack a little bag and “run away” and just stand outside lol.

I'm not a lawyer, but I've spent many years court watching. I also used to review credit reports professionally. Here's how most states' small claims courts work:

Tammie would have to make a claim that small claims court actually covers. That means provable damages and/or a provable debt/loan that the defendant failed to pay as agreed. The standard of proof is "preponderance of the evidence", meaning a 51 percent likelihood that the plaintiff is right.

Winning in small claims court means you get a "judgment" against the defendant, not a court order to do something in particular. This includes default wins (where the defendant fails to show up in court).

The defendant's credit report will show the judgment unless the defendant pays off the debt ASAP into the court registry. If the defendant pays the plaintiff directly, they'll need to get the plaintiff to fail a paper to the court showing the judgment should be listed as satisfied.

The judgment will show up on ALR's credit report as either satisfied (if it's paid) or unpaid for as long as the credit agency shows unpaid judgments. That used to be 7 yrs on the big credit agencies like Experion, but I'm not sure if that's still true. The court isn't in charge of what's on credit reports.

She can't successfully claim generalised damages without showing receipts or something like akin to a blue book value on a car (for example). If she says ALR broke something, she needs to provide something showing what that item would have been worth. If it's a loan, she needs to show SOMETHING that is evidence the money was supposed to be repaid (and wasn't just a gift).

But the standards for evidence aren't particularly high. Think texts, social media posts, proof of prior installment payments going into the plaintiffs bank account, photos of broken shit, witness testimony, police reports, etc, the court will take that into consideration. It's not a murder trial.

If ALR doesn't show up, Tammie will probably get a default. Lazy judges just rubberstamp them. A good judge will glance through the file and throw out a "defamation" bullshit case, though.
