He's got a medical marijuana card, which means he can't legally purchase a firearm, because he can't truthfully answer Question 21(e) about being a drug user to include marijuana. He'd fail a NICS check based on that question alone. Chad cannot knowingly allow him to have access to his firearms.

I don't think BATFE will do anything about it, because what the fuck do they care.
 
Assuming he gets found guilty I can't wait to see how they go about trying to get a lenient sentence. Boogie has bragged for years about how much he helps people in the local community, and that's the exact type of thing that would help minimise his sentence. It will be fascinating to see if and how he brings that up, because I've always suspected 3/4 of it is complete bullshit.

I don't think they've actively prosecuted over this. I know Hawaii State Police told medical card holders they had to surrender firearms and I think a couple other jurisdictions did as well. The ATF also has enough shit on their plate right now and very few agents. FPS Russia was a different animal from Boogie.
 
The judge can deviate from the grid guidelines, but has to justify an upward departure. In theory, he could give Boogie six years in prison. In actuality, I don't see any reason this is a particularly outrageous crime. It was stupid and reckless but nobody was actually hurt and the victim was acting like a complete cunt.
Is there a legal distinction between recklessly endangering people and accidently killing someone? I know there would be additional charges like manslaughter, but I'm asking more in terms of the judge justifying an upward departure. Would it be reasonable for the judge to say "no one was hurt, but they plausible could have been so I'm upping the sentence"?

Either way I agree it's unlikely, but I'm holding out hope for a Boogie prison arc.
 
The best thing for both retards is to be thrown in jail for a month so they have to eat shitty food and watch basic cable. Fuckers are so glued to the internet and whatever baby shit they do all day that removing both children from their toys might actually have an effect.

Oh who the fuck am I kidding? Jail time would have Boogie whining about his harrowing experience in regular jail (having to sit and do nothing) and Frank would pretend like he was in prison for 3 years.

I think we need a new poll if possible for what the outcome of Boogie's case will be, I think he'll most likely just get community service and probation (along with crying about it online), but him finally becoming Boogie1488 in prison would be a fun timeline.

To be fair, any action or inaction on his part will pored over and dissected for any possible motive.
If he were to take a break, do normal adult things, come back and not react then he would help cast doubt upon the "haters"

Regardless of where it was kept, he obviously had access to it because he used it.

That's actually an element of the offense, and generally, just meeting the elements of the offense doesn't by itself justify an upward departure. He could find it was especially heinous in this case because of the area being a residential neighborhood with a nearby church and school.

(a) A person commits aggravated assault if, under circumstances manifesting extreme indifference to the value of human life, he or she purposely:
(1) Engages in conduct that creates a substantial danger of death or serious physical injury to another person;
(2) Displays a firearm in such a manner that creates a substantial danger of death or serious physical injury to another person; or
[an irrelevant subsection]
So he'd really have to find something more than "extreme indifference to the value of human life," since otherwise, you wouldn't even bother having a grid, you'd just give everyone the max sentence. By definition, it's always possible someone could have been injured if it's an aggravated assault.

By that stage, however, Boogie had already shot in the air and pointed the gun at Frank with the threat to shoot him (if Frank doesn't get off his property). Frank's comment might also be considered by a court as just an insult or even just an (erroneously ludicrous) statement, rather than a threat to commit sexual violence on Boogie.

[Edit: I believe it's actually "Hassle Doctrine" that allows Frank to take one inside one's own dwelling and fuck them.]

The DA isn't in the business of trying losing cases. They wouldn't have brought the charges unless they felt reasonably certain of at least a plea deal. He's in some hot water, which is why he has a warrant out for his arrest and has an attorney. Yea he's probably going to get off with a couple years probation, maybe a week at most in county and some heavy community service or something but this isn't something that's just going to magically go away on a technicality. It's all on film, for starters.
 
Biggest laugh I've gotten from Boogie in 10 years is thinking of him in an OJ style Bronco chase, except he's on a mobility scooter.

You can't even possess a firearm if you use weed, legal or not, according to the Feds because it's still a Federally illegal drug.
