FYI the Sony Eurostan dudes are just glorified internet jannies, they're not the big boi corporate lawyers who would actually fuck things up for everyone involved. When Manhunt 2 was leaked back in 2007 the Euro guys were the ones who tried to take down all instances of manhunt 2. Now Psygnosis was a studio that was beloved for wipeout and later became Studio liverpool and Manhunt 2 being leaked was under their watch. Their games didn't sell as much as expected and when it came time to clean out corporate excess the Manhunt 2 incident played a part in why Sony ended the studio.
Like it or not, the large companies have to protect their assets, because say another game from another studio gets leaked they don't want a reputation of having partners get burned and having no protection for their hard work and IP. TLOU2 is clearly a bad game and the rushed release date means that Sony has had enough throwing good money after bad. Naughty Dog was already in hot water before with the million dollar church display that was received negatively with the TLOU2 reveal.
Basically while the European threats lack actual teeth for outsiders, they will document the incompetence of the developers and if the developer's mistakes has cost them too much money then the hammer comes down on them. It's less about threats and more about saving face just in case a similar situation arises in the future they need to be able to have the trust of other companies that some form of protection will be deployed.
