I don't think Doucette would hide it was him, or if he did, be able to go this long without calling Ty, Percy. Doucette is trying his hardest to get sued so if he was going to come here, he'd probably make the account under his name, get it verified, and then start defaming Vic, Ty, and Nick as much as he could.

DinkyCow is remaining calm through this, so I don't think they are any of the main KV people. We all know their OpSec sucks.

Watching KV do their shit is kinda like watching Mountain Monsters. You want to look away but can't and if they can't find a monster, they'll make one up.
 
Someone should point out that the standards the TCPA asks for are not exactly clear by either precedent or the statute itself and part of the confusion around finding the appropriate standard of pleadings is that the Texas Supreme Court hasn't provided a clean cut standard for evaluation. Rereading Lipsky, as well as its surrounding jurisprudence, it's evident to me that the TCPA has created a major interpretative problem for the lower courts and the Appellate Courts. Even if Lipsky establishes the proposition that circumstantial evidence does not run afoul of the "clear and specific" requirement, the exact contours of the standard are still mostly unknown and untested.

The ideal solution would be for the Texas Legislature to step in and tell the courts what exactly the fuck "clear and specific" is supposed to mean, and given they've recently amended the TCPA, it's pretty obvious that the statute isn't exactly functioning as intended.

It would be a shame if we had a 10-page argument or something over this.

Yeah, I got into this for the fascinating legal aspects. I heard about this whole thing on another forum with lots of legal experts, and there wasn't really any debate over it. No opinion about who is telling the truth here, just opninions about the legal filings. I can even flatly admit my bias: the original letters from Ty alleging defamatory statements that included, among other things, statements calling Vic a piece of shit, irked me. I don't like people using the legal system to try and silence opinion. If you have a real case, stick to the facts.

I know, and I can't wait to come back on the third day once everyone is done crucifying me.

I do admit it is a low risk high reward bet for me. If I'm totally right and Vic ends up losing the entirety of the case because of how horrendously Ty has performed, I get to strut around like king of the bitches for a couple days. If I'm totally wrong and the appeals court not only overturns every decision that Chupp has made but sends him and the defendants immediately to jail, do not pass go do not collect $200, then I can just run away in shame and everyone will be happier ever after.

I still like my chances.
