Stopped reading at "Todd's case seems much more unclear." He's got the fucking texts proving this bitch lying! Unclear is just a codeword for "unfavorable to my predetermined outlook."

This guy is a fucking moron even before you start laughing about how he has a head like a fucking grape that grows in a cave that never sees sunlight. If anybody else wants to do a deeper spelunking into this autism cenote, you're a better man then I.

Most of it is decent or easy to see how he came to that conclusion then you get to the Nick section. That was something else! It's easy to piss all over what he said, but it's been done over and over for that sort of thing. Everything he stated there is so twisted and warped to his delusions it is absolutely hilarious.

I said it elsewhere, but these morons don't understand that 'support for Trump' could purely be 'Oh, I voted for him over Hillary because she's anti-Christian and/or a demon in semi-human form, and I don't know, I guess I'll vote for him again, since I'm okay with how the country has fared under him'. Like any normal, sane, non-political person behaves about a president they have/will vote for. Not everyone bothers to keep up on every stupid headline news cycles barf out about the president every year. I wouldn't be surprised if he supported every modern president except maybe Bill and H. W. - it's normal behavior that overly political idiots like Sabat blow out of proportion just because the one in office happens to be Trump right now. Thus, just being that way would be enough to get discriminated against in the environment Huber describes.

Which they are perfectly illustrating by jumping to the conclusion that he's a hardcore supporter and must agree with 'xyz bad thing'.

Three affidavits (Chuck Huber, Vic Mignogna, and Chris Slatosh) attached to the TCPA response were notarized by Ty Beard, but they were withdrawn. The defendants made the accusation that those affidavits weren't signed by the affiants in Ty's physical presence, which would make the notarization improper. Nick's spin was that Ty just didn't know that you can't notarize something unless it's signed in your physical presence. I'm not sure I buy the idea that the senior partner of a law firm wouldn't know how notarization works. I suppose that does put the onus on the defendants to prove that it's fraud as opposed to an honest mistake, though.

Personally, I suspect that remotely notarized documents are relatively common, despite being improper; they probably aren't contested often, and if they are, it can just be played off as a mistake, as they're doing now. It may have just been a roll of the dice... what really puzzles me, though, is why? Nick said that an unsworn declaration would work just as well; if so, then why even take the risk of improperly notarizing them? Especially when the defendants are desperate to latch onto any mistake that they can find in Vic's filings, either real or apparent?

An amended version of Vic's petition (that's the lawsuit itself) was then filed, which contained those 3 statements, so BHBH could still get them into the court record prior to the TCPA hearing. This caused no small amount of consternation from defendants at the "surprise" filing which they claim violated their Rule 11 agreement (however, the Rule 11 agreement specified a deadline for Vic's TCPA response; it said nothing about an amended petition).

Honestly, it will be even more hilarious to watch the outcome of this hearing with that sloppy filing in mind. It just adds to embarrassment if Ty wins.

I don't recall the substance of the filing being sloppy. Footnotes were incomplete at times, though, and then there was the notarization issue. The former would likely have been something delegated, though, so someone dropped the ball, there.

The best I can say about it is if he doesn't do notarizations often, it's a facially plausible claim sufficient to defeat a motion based on allegations of intentional fraud.

That, and as Nick says, any remedy would likely just be to strike the improperly notarized affidavits. As BHBH withdrew them before this could occur, they can argue that the affidavits did not result in any prejudice against the defendants; they weren't harmed. Fuhrer J-Dolph is overplaying his hand by asking for sanctions that go beyond simply striking the affidavits; further sanctions would be extraordinary.
