Twitter started giving blue checks to anyone who isn't blatantly obviously guilty of thoughtcrime and is willing to privately provide their ID. It's likely related to the congressional hearings about bias that has them all a little worried. (All it's really causing them to do is be more subtle, though.)
Remember, the same people obsessed with constant affirmative verbal consent also believe if a woman retracts her consent after the fact that makes it retroactive rape. The more fringe SJWs think that all "PIV" (penis in vagina) sex is inherently rape, it's just that sometimes women are temporarily ok with it.
So a recording would be invalid either way.
And, bringing it back to the Vic situation, Louis CK did everything they expected Vic to do. He took the L, apologized, owned up to what he did, got therapy, went away for a while... and when he tried to come back they lost their shit on him and flat out said that no, he would NEVER be welcome back, because he admitted guilt and apologized which means he was now and forever guilty and had been banished from polite society.
Which is even stupider when you realize that his great crime was he had a thing for awkwardly asking his girlfriends to let him fap in front of them -- and they gave him consent. But they decided months or years later to revoke said consent, and it became retroactively inappropriate. (This was part of a greater plot by SJWs to push out straight/white/men from comedy, in a GG/CG/etc style entryism move.)

I think that Nick addressed this on one of his streams earlier this week. There's no rule or case law that says that they're allowed to amend their TCPA motion after the filing date, which is why if you look at the newest affidavits, they're actually filed as a supplement to their motion. However, there's also nothing that specifically says they're not allowed to do it either.
I don't think that the judge would have a difficult time ruling any of those newest additions as inadmissible for the purpose of the TCPA motion. They could certainly be amended to the defendant's response assuming that the case survives the TCPA motion, so I don't see the judge viewing that as being particularly prejudicial towards the defendants either.
They not only had their 60 days to secure those affidavits, but on top of that they even received an extension from Ty via a rule 11 agreement. I wouldn't want to try to argue why that supplement should be allowed, particularly when it involves only people who were involved since the very beginning of all of this. Why didn't they have affidavits from two people who participated in the Funimation investigation or from convention organizers that canceled Vic's appearances within the first few weeks of this controversy starting? It isn't as though any of those individuals only became recently involved or that the defense would have had any difficulty contacting them.

Let's not fail to mention how little this senior assistant to the attorney general at the appellate division of the Oregon DOJ actually made at the absolute peak of her career and the paltry pension that she receives, having supposedly been someone of importance. Seriously, if you wanna see something funny, just look for other senior assistants to the attorney general at the Oregon DOJ and take a look at their pay in comparison to hers. She was roughly bottom 10% for full timers.

Remember the panel where that sped called out Chris and Sean for stabbing Vic in the back? Watch the rest of the panel, Sabat is pretty much checked out of it afterwards. If I remember correctly, a few people voiced their anger/annoyance in the crowd, otherwise it was mostly silent.
Sabat may be capable of more introspection than the rest... He may be acutely aware of what's about to happen to him. And where the tide will likely turn.
Judging by Vic's lack of hesitation with naming him, there's no doubt in my mind that he's in the next round. I have a funny feeling he isn't going to get a lot of mercy, either.
