Now, Vic and Ty could just go to court and say that Rial altered the events of the incident she recalled four months ago, now that we could actually do that. I stupidly never thought we could do that because I assumed that she was a little bit smarter than she actually was.

They can immediately appeal a denial of a TCPA motion, which is the next obvious delaying tactic if they lose at that stage.

It's called a supersedeas bond. Most if not all states have a similar rule. You don't need to put it up to appeal, though. It just prevents the plaintiff from collecting while the appeal is pending. Gawker got nuked by one of these.

The way it can prevent you from appealing is if you're essentially bankrupt at that point and can't afford to bankroll it, although in theory, the bankruptcy trustee could also file an appeal on behalf of the bankruptcy estate.

One of the most famous supersedeas bond controversies in history was the Pennzoil v. Texaco case, in Texas federal court. Texaco was unable to put up a bond of over $12 billion and ultimately ceased to exist as a going concern.

I'd expect any favorable ruling for Vic to include an injunction that orders the defendants to refrain from defaming him any further. Intentionally violating that injunction could result in them being found in contempt of court and fined/jailed.

If a losing party is effectively judgement-proof, what prevents them from appealing without obtaining a security bond? Just the fact that they'd presumably have difficulty hiring a lawyer?

Nothing. They just might have difficulty paying a lawyer. Also if you go ahead and collect a judgment that is later turned over on appeal you're going to have to pay it back and it will probably end up costing you a lot of money yourself. So in some cases the plaintiff might just hold off on collecting until after the appeal anyway.

I think in this case, though, the defendants are such spuds that he'd probably just go straight to collecting.
