Singer D4vd has been arrested for the murder of Celeste Rivas Hernandez, who was found dead in Hollywood in the trunk of his Tesla in September.

According to the LAPD, D4vd, whose real name is David Anthony Burke, was arrested by the Robbery-Homicide Division for the murder of Hernandez and is being held without bail. The case will be presented to the District Attorney’s office on Monday for filing consideration.

The Los Angeles Police Department confirmed they were investigating a trip the 21-year-old took to the Santa Barbara area sometime during the spring of 2025 following Hernandez’s death. A spokesman for the musician said in September that he was “fully cooperating with authorities,” though as of Nov. 18 NBC Los Angeles reported Burke was no longer cooperating with law enforcement.

Officers were called to a tow yard on Sept. 8 following reports of a foul odor coming from the car, which had been on the property for several days. Police found a dismembered body that had been placed inside of a bag in the front trunk of the vehicle.

The car was registered in Hempstead, Texas to Burke and impounded after being abandoned in the Hollywood Hills, where neighbors complained of a rotting smell. As of Sept. 9, the case was being treated as a death investigation.

Hernandez was reported missing from her home in Lake Elsinore, Calif., last year. She was last seen in April 2024, according to the Riverside County Sheriff’s Department. After her body was found, police said that because a manner of death had not been determined.

Shortly after the discovery, Burke quietly canceled his U.S. tour and postponed the promotion of his deluxe album.

LOS ANGELES (AP) — Prosecutors said Wednesday that singer D4vd killed 14-year-old Celeste Rivas Hernandez by stabbing her multiple times.

The Los Angeles County District Attorney’s Office shared what they said the evidence would show in a document filed Wednesday that provided the first detailed allegations of efforts to dismember Rivas Hernandez’s body and get rid of evidence.

The court filing said D4vd, whose legal name is David Burke, met Rivas Hernandez when she was 11, began a sexual relationship with her when she was 13 and he was 18, and killed her when she threatened to reveal their inappropriate relationship.

“Knowing he had to silence the victim before she ruined his music career as she had threatened, very soon after her arrival at his home, defendant stabbed the victim to death multiple times and stood by while she bled out.”

Her body was found decomposing in a Tesla towed from the Hollywood Hills in September of last year.

Prosecutors obtained text messages between the two from April 22, 2025, the night before all her phone activity went quiet and they believe she was killed.

“The messages reveal the victim’s jealousy over defendant’s relationships with other women, as defendant led her to believe they had a future together. She became extremely upset and threatened to disclose damaging information about her relationship with defendant to end his career and destroy his life,” the document says.

The document says Burke bought two chainsaws online that he used to cut apart her body in an inflatable pool.

“Defendant took horrifying measures to destroy and discard the victim’s body,” prosecutors said in the brief. Two of her fingers were missing when the body was found. Rivas Hernandez had his name tattooed on them, they said.

Prosecutors had not previously described how they believed Rivas Hernandez was killed or given details on their relationship. An autopsy report said she was killed by penetrating wounds.

Burke has pleaded not guilty to first-degree murder and other counts. His lawyers have said he is innocent and did not cause Rivas Hernandez’s death.

The defense attorneys asked Superior Court Judge Charlaine F. Olmedo at a hearing Wednesday to seal the document, but she declined. They had no comment outside court.

D4vd appeared in court Wednesday as his lawyers asked that his preliminary hearing be delayed several weeks. The evidentiary hearing that was set to begin Friday has been pushed to May 26.

Minutes after the hearing ended, prosecutors released a blockbuster evidence brief claiming that “surveillance video and other evidence confirm defendant was the last person to drive” his Tesla before the dismembered and decomposed remains of 14-year-old Celeste Rivas were found in the front trunk last September.

The brief, obtained by Rolling Stone, claims the platinum-selling singer, born David Anthony Burke, first met Rivas when she was 11 years old. Prosecutors allege Burke “began a sexual relationship” with Rivas when she was 13, and that Riverside County officials contacted Burke in February 2024 and informed him of her age after she was reported missing by her family.

Despite being contacted by law enforcement, Burked “continued to pursue” Rivas, the filing states. He allegedly drove to her home in Lake Elsinore, south of Los Angeles, and “paid a junior high school student in the victim’s class $1,000 to give the victim a cell phone [that he] purchased so they could stay in contact,” prosecutors claim.

Recovered texts between Burke and Rivas “contain references to sex, pregnancy, abortion, and use of the Plan B emergency contraceptive,” the brief alleges. Burke and Rivas also exchanged “explicit photographs documenting and corroborating their sexual relationship,” it claims.

According to prosecutors, Burke “broke up” with Rivas in November 2024, though they continued to communicate. The new nine-page filing alleges Burke and Rivas “engaged in a lengthy argument described in detail in their text messages” on the night before Rivas was last seen alive.

“The messages reveal the victim’s jealousy over defendant’s relationships with other women, as defendant led her to believe they had a future together,” the brief reads. Rivas purportedly became “extremely upset and threatened to disclose damaging information about her relationship with defendant to end his career and destroy his life,” prosecutors claim. Burke sent an Uber to pick Rivas up from Lake Elsinore on April 23, 2025, the night she allegedly was murdered.


Prosecutors allege Burke texted with Rivas during her ride, and that the driver dropped the teen off at Burke’s Hollywood Hills address around 10:10 p.m. Burke then sent text messages to Rivas at 10:30 p.m., inquiring where she was, the filings states.

“The people contend this was part of defendant’s premeditated plan to cover up the murder, as she was already dead by this time,” the filing reads. “Knowing he had to silence the victim before she ruined his music career as she had threatened, very soon after her arrival at his home, defendant stabbed the victim. todeath multiple times and stood by while she bled out.”

Prosecutors allege Burke left his home at 11:30 p.m. and texted and called Rivas’ phone, asking where she was. “Again, these acts were calculated and planned to set up his defense,” the filing states. Burke allegedly drove to Lake Cachuma in Santa Barbara County, returning home the next morning to attend a radio interview. He later ordered a shovel from Home Depot, which was delivered by Postmates on April 24, 2025, and two chainsaws, a body bag, heavy-duty laundry bags, and a blue inflatable pool, which were delivered by Amazon in early May, the filing claims.

Burke made the purchases under a fake name, Victoria Mendez, and returned to Santa Barbara County twice more, the brief alleges. He also ordered a “burn cage” to his home under the same fake name, “as part of his plan to incinerate evidence,” prosecutors contend.

“The circumstances and present state of discovery led us to conclude we need this additional time to review the discovery we just got or are about ot get,” Burke’s defense lawyer Marilyn Bednarski said at the Wednesday afternoon hearing.

Judge Charlaine Olmedo asked Burke if he agreed to the postponement. “Yes, your honor,” he replied.

Burke, 21, has been charged with the first-degree murder of Celeste Rivas Hernandez, the 14-year-old girl found dismembered and badly decomposed in the front trunk of his Tesla last September.

Prosecutors also charged him with continuous sexual abuse of a child under the age of 14 and unlawful mutilation of human remains. They added special circumstance allegations of murder of a witness, murder for financial gain, and lying in wait, which makes him eligible for the death penalty. (Though prosecutors have not yet decided whether to pursue it.) Burke has pleaded not guilty.

Last week, Deputy District Attorney Beth Silverman revealed that Burke’s iCloud account, obtained by investigators, contained what she described as “a significant amount of child pornography.”

Burke’s lawyers, Marilyn Bednarski and Blair Berk, pressed for an immediate preliminary hearing. Judge Charlaine Olmedo said it would begin this Friday, May 1.

Burke was arrested on April 16 at a house in the Hollywood Hills. Prosecutors said police served a simultaneous search warrant at the property not far from the iconic Chateau Maramont hotel. Silverman said the case involves a large volume of evidence, including material obtained through a wiretap, and that three grand juries were convened in recent months to investigate.

A long-awaited autopsy report released last week concluded Rivas died from “multiple penetrating injuries” to the upper abdomen. It described two stab wounds that perforated her liver and chest. The manner of death was ruled a homicide.

The report also described the condition of her remains, noting dismemberment and advanced decomposition that made visual identification and fingerprinting impossible. Toxicology showed a low level of ethanol and presumptive positives for several drugs pending confirmation.

Prosecutors allege Rivas was last seen entering Burke’s Hollywood Hills home on April 23, 2025, and was killed that day. They contend her body was mutilated weeks later. Burke’s lawyers have said he “did not murder Celeste Rivas Hernandez.”

If convicted as charged, Burke faces either life in state prison, without the possibility of parole, or the death penalty. Prosecutors have said a decision on whether to seek the death penalty will be made at a later date.

Born in New York and later raised in Texas, Burke first gained attention as a Fortnite gamer and musician with the self-produced song, “You and I.”

He broke through to mainstream success in the summer of 2022 with the hit singles “Romantic Homicide” and “Here With Me,” after they garnered so much traction on TikTok, they jumped to spots on the Billboard charts. He released his debut EP, Petals to Thorns, in May 2023.

His debut studio album, Withered, was released in April 2025, two days after Rivas was seen for the last time.

At a press conference, LADA Nathan Hochman claimed that Rivas was only 13 years old when Burke allegedly engaged in repeated “lewd and lascivious sexual relations with her.”


“Burke’s actions did not allegedly stop there,” he said. “When she threatened to expose his criminal conduct and devastate his musical career, Burke allegedly murdered her, cut up her body and stuffed her body in two bags that were placed in the front trunk of his car.”

No, you don't need proof beyond a reasonable doubt to arrest someone, or nobody would ever get arrested because you'd have to do an entire jury trial just for the arrest itself. You just need probable cause that a crime was committed, which is a much lower standard of evidence. It just has to be reasonable. After that you just need a grand jury indictment with probable cause. Finding a corpse in someone's car should get them arrested immediately in almost all cases. You can bet if a body was found in your abandoned car you'd be arrested immediately. The whole point of the "justice system" is to keep murderers and rapists off the street and if they fail to do that you slide into anarcho-tyranny where the only time the law is enforced is when a good, law abiding citizen renegades on some paperwork while every vagrant or bum gets to spend years harassing them. It's always easier for law enforcement to target you because unlike murder hobos you attempt to follow the law, aren't going to violently resist arrest, and have a job and a permanent living situation that makes it easy to find you at any time.

Anyway, they did end up arresting this guy and almost immediately established a motive, so I'll give them that even if I can't condone them letting him roam free for months.

To be fair to the cops, this was pretty obviously a premeditated murder of a very specific girl, and so letting him roam free didn't really unduly endanger the public, and likely let them get a lot more shit on him.

I've read too many fucking cases where they nabbed the perp immediately, and then had to let him go because they lacked evidence enough to hold him, and then he did some serious shit/destroyed evidence once out.

The plea bargain is offered by the prosecutor so it could be beneficial for the defense to make their job harder. At the very least the defense is probably hoping for something like "Minimum 20 years in prison + eligible for parole afterwards" with the death penalty off the table.

You don't even "need" that, you can skip the Grand Jury and go right to trial. It's not a legally mandated step, just one a prosecutor can use at their discresion.

A GJ is usually a rubber-stamp used in cases like this that are highly public, highly charged or highly controversial where the DA can say "look, 12 people agreed we have enough to go to trial".

Similarly, a lack of indictment is often used as an excuse to drop a trial that the DA doesn't want to handle for PR/political reasons. (and cynical folk will say you can always engineer this by showing your weakest evidence to 12 people who'd rather be somewhere else that day).

Yeah some comments here are pretty naive. When I was living in an apartment in college, there was a spic family at the bottom floor and the mother was a loudmouth who was shaped like a refrigerator. Things I found notable:
Surveillance video and other evidence confirm D4vd was the last person to drive the Tesla on July 29, 2025 before he left for his tour.
Celeste had been reported missing by her family in February and April 2024. (Stop listening to clickbait niggers like JiDion)

Riverside County Sheriff's Department had phoned D4vd February 17, 2024 after they identified his number in Celeste's phone. During the call D4vd claimed he had last spoken to Celeste February 13 or 14, 2024, but claimed he didn't know she was a minor or had been reported missing. They conducted a welfare check on his home, he again claimed he didn't know she was a minor, she returned home 2 days later.
After she returned home, her parents took away her cell phone.
D4vd drove to Lake Elsinore (where Celeste lived) and paid a junior high school student in Celeste's class $1,000 to give her a cell phone that D4vd bought.
She spent a lot of time with D4vd throughout 2024, including summer weekends at his home in the Hollywood Hills and traveling with him to Las Vegas, London, and Texas to meet his family.
Texts between D4vd and Celeste contained references to sex, pregnancy, abortion and Plan B contraceptives.
Explicit photographs documenting their sexual relationship from when she was 13.

They "broke up" November 2024, but continued to communicate and continued sexual relations.

All her cell activity ceased April 23, 2025, which is likely the date of her death.
Text arguments show she was upset of his relations with women. She threatened to out him as a pedophile to destroy his career.
D4vd sent an Uber to pick her up and drop her off at his residence.
He continued to text her after her death, inquiring about her whereabouts as part of a premeditated plan to cover up the murder.
He drove to Santa Barbara County immediately after she died, attempting to dispose of her property and destroy evidence. He then went home in the early morning to do a radio interview on April 24, 2025.
He ordered a shovel from Home Depot and 2 chainsaws from Amazon. He also ordered a body bag, heavy-duty laundry bags, and a blue inflatable pool from Amazon under the fake name "Victoria Mendez." He later ordered a burn cage under the same fake name.
He dismembered her in the inflatable pool with the chainsaw and possibly other tools. As a result, small blue plastic fragments had been found embedded in her remains.

Her left ring and pinky fingers that had his name tattooed on them have not been recovered.
LAPD found the inflatable pool which had multiple linear cuts. Biological samples tested positive for blood. DNA analysis matched the victim's unique genetic profile.
