There are existing laws regarding using tariffs (Trade Expansion Act of 1962, the Trade Act of 1974, and the Tariff Act of 1930) but I think the implementation process and the criteria of what and what cannot have a tariff applied to it is different compared to the more broad stance the Trump administration was using in its interpretation of the International Emergency Economic Powers Act.
