stabbings and explosive were widely used, as well as poison and even small pistols they were able to keep hidden/ smuggle in. One distant cousin i know that was in it committed suicide though.

Most likely, yes. I was just reading an article about this the other day—the bar you have to cross to lose First Amendment protections is very high. For instance, here you could argue he’s not specifically threatening your average ICE agent but instead proclaiming those who have done wring will be arrested and tried a la Nuremberg. Compare to if he tweeted a picture of a specific guy, said “This is John ICEAgent. Next time I see him, I am going to shoot him.” Essentially, unless you are giving a threat that you would reasonably be able to execute, or a more broad explicit call to violence, you’re probably protected.

TL;DR: He’s toeing the line, but he’s just barely on the safe side of it since he’s not giving an explicit, actionable threat.
