I think it's at best a close call but that's not really what you want. You're still looking at getting into six figures for an unpredictable result because fair use is barely even a standard much less a workable one.

Sargon's case was so completely clearcut it was frivolous even to bring it. He put substantial editing into it, and the clips were brief. Nick is doing the entire thing while barely commenting at all during much of it, meaning the use of the full stream wasn't necessary to make any point.

The court did not find in Hughes' favor on even one of the four elements of a fair use test.

Nick's use, just by using the entirety of the work, already starts off on the wrong foot by heavily favoring the plaintiff on the very first element, and I don't see any element where it favors him strongly or, for that matter, at all.

About the only one I could make a half-decent argument about is the fourth, the impact on the market for the work. While is often by itself a determinative factor, I still don't see it strongly favoring him, even though the market impact is probably minimal, that is, anyone who for some reason wanted to watch an autistic lawyer make mediocre food probably wouldn't want to hear some coked-up retarded faggot babbling on and on over it.
