But, if you believe that Destiny is a legitimate narcissist as I do, then realistically most of these people are both victims and victimizers. Nearly all of them have been a narcissist's flying monkey, including Pxie who did a lot of sanitization of Destiny after the Max/Lav stuff. She, along with Erudite, is someone who just said that Destiny needed to surround himself with better people, while completely absolving him of all wrongdoing until it affected her. Kyla may do the same, it just hasn't really affected her to an unbearable level yet, and it seems like she's in a position where she's stuck. Which is her own fault, but she seems relatively stuck none the less.

Destiny is a cum vampire, and he has surrounded himself with cum Renfields who all have cum on their hands.

There are some flying monkey Cum Renfields like Dan, who are probably narcissists themselves, and enjoy the drama that happens. Same for people like Darius. Then there are Cum Renfields like Erudite, who do bad things, but I can see why they do it. In her case, she's probably a people pleaser. She also is so caught up in humanizing and empathizing with Destiny that she's going to overlook some thing. And then there's the obvious financial tie to Destiny, which is a very common manipulation tactic that Cum Vampire narcissists use to keep their Cum Renfields in line. Also fear of retaliation.

So I'm not saying that Kyla isn't without cum on her hands, or that she's doing anything good, just that I think of all the motivations to be a cum Renfield, I can sympathize with her. She's probably very easy to take advantage of. And she's also probably someone who would be a good friend if she wasn't hitched to someone like Destiny.

In short, there's a reason people like Kyla are easy to turn into flying monkeys. You just have to tell her about the abuse you suffered as a child and complain about how no one gets you. It makes people like Kyla want to save you and stand by you.

Not to call Erudite's expertise into question, but yeah, it's actually pretty common for narcissists to charm even people who understand psychology. It happens all the time when couples go to couples counseling.

I don't know if you remember, but at one point I was arguing with people in this thread about whether or not Destiny likes to be viewed as a victim. I said that he wants people to think he doesn't like to be viewed as a victim, but he does like all of the things that come along with being viewed as a victim. (I think the way he tries to paint himself as a victim over the last year has proven me right, btw.). Destiny is crafty like that, and someone like Kyla probably does believe his bullshit cause she's kind of a naive simp. She seems like someone who takes people at their word and that's why Destiny likes her.

edit: Keep in mind, though, I think that there's enough evidence of Destiny being a piece of shit that there's no way she doesn't see it at this point. The problem is that Destiny's self image is not in alignment with reality. He really does see himself a certain way, so when an empathetic person comes into contact with him and they see him the way he sees himself, you get Erudite. How many times did he complain about how people don't see him the way he sees himself? That's Erudite's value to him.

Pretty much. Discovery in a federal civil case will be governed by Fed. R. Civ. P. 26-37. Rules 26 and 34 are most relevant to the discord stuff, as they are the general provisions and rules regarding ESI docs respectively.
The long short so long as it is within scope of discovery and not privileged, he has to hand it over if it’s asked for by Opp. Counsel. If he doesn’t want to hand over certain documents, say on the basis he an his counsel feel it’s outside 26(b), he could refuse and force the opposing side to go to the Court. But doing that just because he doesn’t feel like handing it over would be astronomically retarded if he doesn’t have a legal basis for withholding it. Once he gets a Court order against him he has to hand it over or risk sanctions.
If it’s privileged info, he would have to consent assuming he holds the privilege. That’s pretty much the only time his consent is actually required. But to my knowledge that’s not relevant to the docs at issue.

Edit: this all works differently if this is a request to produce served on discord itself. That would probably require Tiny’s consent, but I see no reason to serve discord over him unless he has lost all the relevant logs in question. I’m not entirely sure without doing much more research into the relevant case law from the circuit and district how it would work if they requested it from both, but only discord had it and Tiny refused. But a cursory look seems unfavorable to tiny.

Any lawyers want to chime in on how this looks for the defendant:

• Insufficient preservation of evidence

Well, I would say that this standard would need to be applied to everyone then. I don't want to give mrgirl any credit because he's an idiot crybaby, but I think there was enough reason after their split for every single orbiter and fan to realize what a bad person Destiny is. But instead, they all white washed him and defended him and none of them really took him to task over Anavoir. Why should I feel bad for Pxie when she stood by him through Anavoir? How about Chaeiry? All of the people in Shaelin's 4Thot art WERE doing the same things Kyla does. (Maybe not Brittany Simon. She was onto Destiny pretty early I think and was the only one to say that everyone in this saga sucks.)

Chud was one of the biggest ball washers of them all UNTIL Destiny tried to get him to get rid of DK. But up until then, he defended Destiny, he went after Destiny's enemies, etc. Chud is kind of tongue in cheek about it, calling Destiny his former master, but if you go back and watch Chud's coverage leading up to the DK thing, he was pretty deeply under Destiny's influence.

I look at this from a point of view of who would probably be a decent person if they weren't under Destiny's influence, and I think it's most of the orbiters with a few exceptions. Dan is one of those exceptions, because I think he's a bad guy even without Destiny and he's drawn to Destiny because they have a lot in common. He's the only one I think doesn't have a breaking point because he's said that he would help Destiny hide the body. I just don't know what Erudite's breaking point is.

Edit: I just really dislike Dan, though. I've disliked Dan ever since I saw him try to convince Destiny not to have his son come out for the summer and I got the impression that it's because Dan didn't want to have to share Destiny with his son when he was trying to get that wack ass podcast off the ground.
