Aug 29 (Reuters) - Elon Musk's artificial intelligence startup xAI has sued a former engineer at the company for allegedly stealing trade secrets related to its Grok chatbot and taking them to rival OpenAI.

Musk's company said in the complaint filed on Thursday in California federal court that Xuechen Li stole confidential information related to "cutting-edge AI technologies with features superior to those offered by ChatGPT" to bring to his new job at OpenAI earlier this month.

Li, representatives of OpenAI and attorneys and spokespersons for xAI did not immediately respond to requests for comment on Friday. OpenAI is not a defendant.

The complaint underscores the rivalry between Musk's company and OpenAI and a fierce battle among tech companies for AI talent.

Musk, an OpenAI co-founder, has separately sued the company and its CEO, Sam Altman, for allegedly deviating from its original mission to benefit humanity. OpenAI countersued Musk in April for harassment.

Musk's xAI filed another lawsuit against OpenAI and Apple (AAPL.O) in Texas on Monday for allegedly monopolizing the market for AI chatbots on Apple devices.

The new lawsuit said Li began working as an engineer for xAI last year, where he helped train and develop Grok. The company said Li took its trade secrets in July, shortly after accepting a job from OpenAI and selling $7 million in xAI stock.

Musk's startup said that the secrets could allow OpenAI to bolster ChatGPT with xAI's "more innovative AI and imaginative features."

The lawsuit said Li admitted to stealing company files and "covering his tracks" during a meeting on August 14, and that the company later found additional stolen material on his devices that he had not disclosed.

Musk's AI company asked the court for an unspecified amount of monetary damages and a restraining order blocking Li's move to OpenAI.

I don't consider it stealing if you trained people to do a certain task amd then they quit because they don't want to be human trafficked. Anyway I hope every big name involved here falls into a sinkhole lined with bike horns at the bottom so that everyone laughs when they die.

I knew this was bound to happen because the Chinese are known for stealing corporate secrets. But the fact that Elon is a well-known terrible boss who demands workers slave away for low wages because he thinks he and his brands are that awesome just sealed the deal. It was bound to happen.

He hired people known for corporate espionage, but he isn’t someone who gives enough to inspire any loyalty.
 
If you think this is simply a problem of not hiring American then you haven't seen any engineering department in the US in the past 15 years. These are the TAs of Stanford's CS 224N (Natural Language Processing and Deep Learning) for Winter 2025 (link), and all of them are current PhD students:

Most employers will simply point this out when when asked about why they hire fewer Americans.
Granted, there's probably a selection bias here since foreign grad students are more likely to work as TAs for the money. But taking a single professor's students as an example I'd say there are roughly 5 foreign students for each American.

I hate working with Chinese, because one time I was looking for a job, and the office was pretty nice and cool. They even had a big dog.
Then came the coding part. And I'm asking "what are these libraries" that I have to use - "oh they're all written by our super duper chinese programmer", oh okay so there's documentation how to use it and what's it for and - "no."

And immediately it was clear, the other guys know nothing, this one guy has the entire company around his finger, his code is obfuscated, so everyone has to go ask him to write a new function or ask what function to use... On top of that he barely communicated in English, or ant other language other than Chinese.

And yes I opened his library and his code has no comments at all in there. The function names made no sense. He had documentation --- in private, that he wouldn't share with others.

Thank God I said no.

Why the fuck can't Li show the projects he was involved in for an interview? China has one of the worst labour protection laws where companies can just force workers to sign non-compete agreements spanning 5+ years. For a guy who wants to do AI shit, that's either wagecuck slavery or 5 years without a job, or without meaningful professional growth. What's wrong? Thankfully he lives in America, not the corporate hellscape that's China technology companies.

OpenAI, X, Deepseek and so on stole date from you and I. Did we ever consent to that? Were we ever paid to have our resources being used to train their models?

Serious question.Why doesn't elon just have headquarters in India? If more Indians = better product, then why not get the maximum amount of Indians you can have, by moving your company to Mumbai?
 
I think AI is just the latest and greatest piece of shit out there. It’s making people dumber and while sure it has some uses it’s just going to be used for surveillance and all the things we don’t want to happen. I don’t intend to ever use it and I’m pretty sure my quality of life will be just fine without it.

From personal experience; Cybersecurity and associated bodies are one of the least concerns of the C-Suite. You may be asking how is that so, IP Theft and shit is a real problem, and yes it is, but outside of very select things that aren't government contracts, a lot of shit operates on outdated or absent standards, honor code, and/or third-party audits. People, especially workers, don't like security because it hurts their ability to do their job; because having to spend an extra 20 seconds to do a process or being told "No, all the USB drives are locked down, you can't bring in a memory stick" is seen as some sort of fucking crime. Because the people who make decisions listen to the penny pinchers, and the penny pincher will tell them that if workers could plug a USB stick into their machine, productivity will rise by 35% or some shit; is this true, maybe, probably not, but they don't understand or care about computers, that's nerd shit.

One of the biggest problems, aside from the banks and stock markets, in today's business environment, are there are few to no tech/skilled people making decisions. It's all business school dime counters and people who received degrees in goofy shit. And as a personal aside; something tells me Elon is the type of boss who says "I don't care, get it done" while ignoring what can go wrong. So people ignore or violate the guard rails and it's not a surprise when shit falls apart.

The government only hires citizens for specific things that require clearances. One of the funniest conversations I had was talking about "classified math."
