Aren't they not supposed to tell or tip off the soon-to-be defendants that they're under investigation until the indictment drops? Or is there an exception to that for their lawyers?

Aaron has said that the authorities had a long list of people to interview. It might be as simple as that Nick's received some official notice that he's to be interviewed. If I were Nick, that would make things get really real real quick. It would be difficult to imagine being questioned by some state or federal authorities about another unrelated crime, and to keep that somehow secret from the authorities he is currently hoping to comply with.
