To me this doesn't speak of the Sheriff being in Celeste's pockets, (which is money neither she nor Nickyboy actually earned but rather her dad and his granddad did) To me it reeks of smalltown government incompetence and laziness. Your typical government employee would rather: 1. Do nothing. 2. Collect that pension baby. I can't really blame them tbh, sounds like a sweet gig. However doing nothing to the point where you're actively going against the constitution is a bit insane, but I'm sure this isn't the first time this has happened in a random county in bumblefuck nowhere whose employees are used to doing nothing most of the time. I would imagine once Null & Hardin strongarm them in a way that says "okay if you don't get off your lazy asses we're suing the fuck out of you and we're not taking no for an answer", then the bodycam footage will come out. That's how I read it as a legal layman and a nerd.

At 4:17pm today, the Kandiyohi County Attorney filed a motion asking the judge in Rekieta's criminal case 34-CR-24-341 to "correct Court records to properly reflect that the two body cams were never offered or received as exhibits at the Omnibus hearing", stating that "the import of this issue is significant as under Minn. Stat. 13.82, subd. 7, 'any investigative data presented as evidence in court' shall be public."

Potential bad pr for the department pointing guns at two crackhead women with kids in the house while executing the warrant.

In my opinion, if the bodycam footage was attached as an exhibit to a motion and filed in the court after the commencement of criminal proceedings I would say that definitely counts as evidence. The statute merely says "presented as evidence in court" and makes no mention of what stage of the proceedings it has to be nor does it specify that it has to be admitted to be shown to a jury at trial.
sure. that will be the argument. but will it work? depends on the court.

It could be a few different reasons, and it might not have anything to do with Nick
it most likely has to do with nick. there's no other reason not to release it other than nick's screeching and, presumably, threatening to sue the county if it is released. the idea that it would showcase police misbehavior and make the county look bad is not likely, i don't think. he's already claimed that releasing it would be a violation of his constitutional rights, which suggests to me he believes that he has a case and the state might not want to deal with it.

nick is effectively saying, "look, you convicted and sentenced me based on the evidence which did not include the bodycam, and i haven't even been found guilty yet, so to release the bodycam footage would be a gross violation of my privacy and inflict needless suffering on my family. it would be perceived as vindictive and retaliatory and a clear violation of my constitutional rights."

what's weird to me is that this increases the chances of two court battles instead of just one, unless they're extremely confident they will beat null. if null wins and the bodycam gets released and nick sues in response, the state has to fight two legal battles. but if they just released it, they would only have to worry about fighting nick in court, and they would be more likely to win. this amendment also makes the fight against nick more costly since it offers a strong argument against releasing the bodycam, which nick would definitely point to if he sues the county after its release.

make no mistake, this is strong move designed to keep the bodycam from getting out presumably because nick has been screeching about it, but it does guarantee a bigger fight with nick if it comes out.
